Majma al-Zawaid — Hadith 6473

عَنْ أَبِي هُرَيْرَةَ قَالَ : قَالَ رَسُولُ اللَّهِ - صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ - : " الْبَيِّعَانِ بِالْخِيَارِ مِنْ بَيْعِهِمَا مَا لَمْ يَتَفَرَّقَا أَوْ يَكُونُ بَيْعُهُمَا فِي خِيَارٍ " .
قُلْتُ : لِأَبِي هُرَيْرَةَ عِنْدَ أَبِي دَاوُدَ وَالتِّرْمِذِيِّ : لَا يَفْتَرِقَنَّ اثْنَانِ إِلَّا عَنْ تَرَاضٍ .
رَوَاهُ أَحْمَدُ ، وَفِيهِ أَيُّوبُ بْنُ عُتْبَةَ ؛ ضَعَّفَهُ الْجُمْهُورُ ، وَقَدْ وُثِّقَ .
Sayyiduna Abu Hurayrah (may Allah be pleased with him) narrates that the Prophet (peace and blessings be upon him) said: "The buyer and the seller both have the option (to cancel the sale) as long as they have not separated, unless it is a sale with a stipulated option (in which case the ruling is different)." (Allamah al-Haythami says:) I say: The narration of Sayyiduna Abu Hurayrah (may Allah be pleased with him) recorded by Abu Dawud and al-Tirmidhi (has the words): "The two should part from each other only with mutual consent."
Ahmad recorded it; its chain contains Ayyub bin Utbah, whom the majority declared da'if (weak), though he has also been declared trustworthy.
