Majma al-Zawaid — Hadith 6357

عَنِ ابْنِ عُمَرَ قَالَ : نَهَى رَسُولُ اللَّهِ - صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ - عَنِ الشِّغَارِ ، وَعَنْ بَيْعِ الْمَجَرِ ، وَعَنْ بَيْعِ الْغَرَرِ ، وَعَنْ بَيْعِ كَالِئٍ بِكَالِئٍ ، وَعَنْ بَيْعِ آجِلٍ بِعَاجِلٍ .
قَالَ : وَالْمَجَرُ مَا فِي الْأَرْحَامِ .
وَالْغَرَرُ : أَنْ تَبِيعَ مَا لَيْسَ عِنْدَكَ .
وَكَالِئٌ بِكَالِئٍ : دَيْنٌ بِدَيْنٍ .
وَالْآجِلُ بِعَاجِلٍ : أَنْ يَكُونَ لَكَ عَلَى الرَّجُلِ أَلْفُ دِرْهَمٍ فَيَقُولَ الرَّجُلُ : أُعَجِّلُ لَكَ خَمْسَمِائَةٍ وَدَعِ الْبَقِيَّةَ .
وَالشِّغَارُ : أَنْ يُنْكِحَ الْمَرْأَةَ بِالْمَرْأَةِ لَيْسَ بَيْنَهُمَا صَدَاقٌ .
قُلْتُ : فِي الصَّحِيحِ طَرَفٌ مِنْهُ .
رَوَاهُ الْبَزَّارُ ، وَفِيهِ مُوسَى بْنُ عُبَيْدَةَ ، وَهُوَ ضَعِيفٌ .
Sayyiduna Abdullah bin Umar (may Allah be pleased with them both) narrates: The Prophet (peace and blessings be upon him) forbade shighar, the sale of majar, the sale involving uncertainty (gharar), the sale of kali' for kali', and the sale of deferred for prompt. The narrator says: Majar means what is in the wombs (of animals). The sale involving uncertainty means that you sell something which you do not have. Kali' for kali' means a debt sold for a debt. The deferred for the prompt is that a man owes you a thousand dirhams, and he says, "I will pay you five hundred dirhams promptly, and you let go of the rest." Shighar is that a woman is married in exchange for a woman, with no dowry (mahr) between them. (Al-Haythami says:) I say: Part of this narration is reported in the "Sahih".
Al-Bazzar recorded it; its chain contains a narrator, Musa bin Ubaydah, and he is da'if (weak).
