Abu al-Malih narrates from his father, who had the honour of being a Companion: There were two women among us; one of them struck the other with a piece of wood and killed her, and also killed the child in her womb. The Prophet (peace and blessings be upon him) ruled that blood money be paid for the woman, and that for the child a slave or a slave-woman, or a horse, or two camels, or such-and-such a number of goats be paid. A man from the family of the woman who had killed her said: "O Messenger of Allah, how can we pay blood money for one (a child) who neither ate anything nor drank anything, nor cried out nor wailed? Blood like this goes unavenged." The Prophet (peace and blessings be upon him) said: "Are you speaking in rhymed prose?" Then the Prophet (peace and blessings be upon him) ruled that the woman's inheritance goes to her husband and her children, and that the payment of the blood money is due from the paternal kinsmen ('asabah) of the woman who killed her.
Al-Tabarani recorded it from his teacher al-Miqdam bin Dawud, who is da'if (weak).
