بَابٌ فِي مَنْ أَخْرَجَ شَيْئًا مِنْ حَدِّهِ فَأَصَابَ بِهِ شَيْئًا .

عَنْ أَبِي بَكْرَةَ عَنِ النَّبِيِّ - صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ - قَالَ : " مَنْ أَخْرَجَ شَيْئًا مِنْ حَدِّهِ ، فَأَصَابَ بِهِ إِنْسَانًا فَهُوَ ضَامِنٌ " . رَوَاهُ الْبَزَّارُ مِنْ رِوَايَةِ مَالِكٍ ، عَنِ الْحَسَنِ الْبَصْرِيِّ ، قَالَ الذَّهَبِيُّ : مَجْهُولٌ .
Sayyiduna Abu Bakrah (may Allah be pleased with him) reports this statement of the Prophet (peace and blessings be upon him): "Whoever brings something out beyond its proper limit and then harms a person with it, that person will be liable."
Al-Bazzar recorded it as the narration of Malik from al-Hasan al-Basri. Al-Dhahabi said: he (Malik) is majhul (unknown).
