بَابٌ فِي مَنْ أَمِنَهُ أَحَدٌ عَلَى دَمِهِ فَقَتَلَهُ
One whom a person trusts with his life and then he kills him

عَنْ رِفَاعَةَ الْقِتْبَانِيِّ قَالَ : دَخَلْتُ عَلَى الْمُخْتَارِ فَأَلْقَى إِلَيَّ وِسَادَةً ، وَقَالَ : لَوْلَا أَخِي جِبْرِيلُ قَامَ عَنْ هَذِهِ لَأَلْقَيْتُهَا لَكَ . قَالَ : فَأَرَدْتُ أَنْ أَضْرِبَ عُنُقَهُ ، فَذَكَرْتُ حَدِيثًا حَدَّثَنِيهِ عَمْرُو بْنُ الْحَمِقِ قَالَ : قَالَ رَسُولُ اللَّهِ - صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ - : " أَيُّمَا مُؤْمِنٍ أَمَّنَ مُؤْمِنًا عَلَى دَمِهِ فَقَتَلَهُ ، أَنَا مِنَ الْقَاتِلِ بَرِيءٌ " . قُلْتُ : رَوَى لَهُ ابْنُ مَاجَهْ : مَنْ أَمَّنَ رَجُلًا عَلَى دَمِهِ فَقَتَلَهُ ; فَإِنَّهُ يَحْمِلُ لِوَاءَ غَدْرٍ يَوْمَ الْقِيَامَةِ . رَوَاهُ أَحْمَدُ وَالطَّبَرَانِيُّ ، وَرِجَالُهُ ثِقَاتٌ .
Rifa'ah al-Qitbani narrates: I went to al-Mukhtar. He placed a cushion for me and said: "Had my brother Jibril not just got up from it, I would have placed it for you." Rifa'ah said: I intended to strike off his head, but then I remembered a hadith which Sayyiduna Amr bin al-Hamiq (may Allah be pleased with him) had narrated to me; he said: The Prophet (peace and blessings be upon him) said: "Any believer who grants another believer safety for his life and then kills him, I am free of such a killer." (Allamah Haythami says:) I say: Ibn Majah has, from this Companion,
recorded this narration: "Whoever grants a man safety for his life and then kills him will carry the banner of treachery on the Day of Resurrection."
Ahmad and al-Tabarani recorded it, and its narrators are thiqat (trustworthy).
