بَابٌ فِي مَنْ جَلَدَ حَدًّا فِي غَيْرِ حَدٍّ
One who inflicts the number of lashes of a prescribed punishment for an offence other than a prescribed one

عَنْ النُّعْمَانِ بْنِ بَشِيرٍ قَالَ : قَالَ رَسُولُ اللَّهِ - صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ - : " مَنْ جَلَدَ حَدًّا فِي غَيْرِ حَدٍّ فَهُوَ مِنَ الْمُعْتَدِينَ " . رَوَاهُ الطَّبَرَانِيُّ ، وَفِيهِ مُحَمَّدُ بْنُ الْحُسَيْنِ الْفَضَّاضُ ، وَالْوَلِيدُ بْنُ عُثْمَانَ خَالُ مِسْعَرٍ وَلَمْ أَعْرِفْهُمَا ، وَبَقِيَّةُ رِجَالِهِ ثِقَاتٌ .
Sayyiduna al-Nu'man bin Bashir (may Allah be pleased with him) narrates: The Prophet (peace and blessings be upon him) said: "Whoever gives as many lashes as a prescribed punishment for an offence other than a prescribed punishment is among the transgressors."
Al-Tabarani recorded it; its chain contains Muhammad bin al-Husayn al-Faddad and al-Walid bin Uthman, the maternal uncle of Mis'ar, and I do not know either of them; the rest of its narrators are thiqat (trustworthy).
