Book of Legal Punishments and Blood Money
بَابٌ فِي مَنْ كَفَرَ بَعْدَ إِسْلَامِهِ - نَعُوذُ بِاللَّهِ مِنْ ذَلِكَ - وَهَلْ يُسْتَتَابُ ؟ وَكَمْ يُسْتَتَابُ ؟
One who disbelieves after accepting Islam (we seek refuge with Allah from that), is he asked to repent, and how many times

وَعَنِ ابْنِ عَبَّاسٍ عَنْ رَسُولِ اللَّهِ - صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ - قَالَ : " مَنْ خَالَفَ دِينُهُ ، دِينَ الْإِسْلَامِ ، فَاضْرِبُوا عُنُقَهُ " .
وَقَالَ : " إِنْ شَهِدَ أَنْ لَا إِلَهَ إِلَّا اللَّهُ ، وَأَنَّ مُحَمَّدًا رَسُولُ اللَّهِ ; فَلَا سَبِيلَ عَلَيْهِ إِلَّا أَنْ يَأْتِيَ شَيْئًا فَيُقَامَ عَلَيْهِ حَدُّهُ " . رَوَاهُ الطَّبَرَانِيُّ ، وَفِيهِ الْحَكَمُ بْنُ أَبَانٍ وَهُوَ ضَعِيفٌ .
وَقَالَ : " إِنْ شَهِدَ أَنْ لَا إِلَهَ إِلَّا اللَّهُ ، وَأَنَّ مُحَمَّدًا رَسُولُ اللَّهِ ; فَلَا سَبِيلَ عَلَيْهِ إِلَّا أَنْ يَأْتِيَ شَيْئًا فَيُقَامَ عَلَيْهِ حَدُّهُ " . رَوَاهُ الطَّبَرَانِيُّ ، وَفِيهِ الْحَكَمُ بْنُ أَبَانٍ وَهُوَ ضَعِيفٌ .
Sayyiduna Abdullah bin Abbas (may Allah be pleased with them both) reports this saying of the Prophet (peace and blessings be upon him): "Whoever abandons his religion, that is, Islam, strike off his neck." And he also said: "Whoever bears witness that there is no god but Allah and that Sayyiduna Muhammad is the Messenger of Allah, then nothing can be done against him, except that if he commits a crime, he will be given its punishment."
