Majma al-Zawaid — Hadith 10569

وَعَنْ كَعْبِ بْنِ عَلْقَمَةَ أَنَّ عَرَفَةَ بْنَ الْحَارِثِ - وَكَانَتْ لَهُ صُحْبَةٌ ، وَقَاتَلَ مَعَ عِكْرِمَةَ بْنِ أَبِي جَهْلٍ بِالْيَمَنِ فِي الرِّدَّةِ - مَرَّ بِهِ نَصْرَانِيٌّ مِنْ أَهْلِ مِصْرَ ، يُقَالُ لَهُ : الْمَنْدَقُونُ فَدَعَاهُ إِلَى الْإِسْلَامِ ، فَذَكَرَ النَّصْرَانِيُّ النَّبِيَّ - صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ - فَتَنَاوَلَهُ ، فَرَفَعَ ذَلِكَ إِلَى عَمْرِو بْنِ الْعَاصِ فَأَرْسَلَ إِلَيْهِمْ ، فَقَالَ : قَدْ أَعْطَيْنَاهُمُ الْعَهْدَ .
فَقَالَ عَرَفَةُ : مَعَاذَ اللَّهِ أَنْ تَكُونَ الْعُهُودُ وَالْمَوَاثِيقُ عَلَى أَنْ يُؤْذُونَا فِي اللَّهِ وَرَسُولِهِ ، إِنَّمَا أَعْطَيْنَاهُمْ عَلَى أَنْ يُخَلَّى بَيْنَنَا وَبَيْنَهُمْ وَبَيْنَ كَنَائِسِهِمْ ، فَيَقُولُونَ فِيهَا مَا بَدَا لَهُمْ ، وَأَنْ لَا نُحَمِّلَهُمْ مَا لَا طَاقَةَ لَهُمْ بِهِ ، وَأَنْ نُقَاتِلَ مِنْ وَرَائِهِمْ ، وَيُخَلَّى بَيْنَهُمْ وَبَيْنَ أَحْكَامِهِمْ إِلَّا أَنْ يَأْتُونَا فَنَحْكُمَ بَيْنَهُمْ بِمَا أَنْزَلَ اللَّهُ ، فَقَالَ عَمْرُو بْنُ الْعَاصِ : صَدَقْتَ .
رَوَاهُ الطَّبَرَانِيُّ فِي الْأَوْسَطِ ، وَفِيهِ عَبْدُ اللَّهِ بْنُ صَالِحٍ كَاتِبُ اللَّيْثِ ، وَقَدْ وُثِّقَ وَفِيهِ ضَعْفٌ ، وَبَقِيَّةُ رِجَالِهِ ثِقَاتٌ .
Ka'b bin Alqamah says: Sayyiduna Arafah bin al-Harith (may Allah be pleased with him) had the honour of being a Companion. He fought alongside Sayyiduna Ikrimah bin Abi Jahl (may Allah be pleased with him) against the apostates in Yemen. Once a Christian from Egypt named al-Mandaqun passed by him. He invited him to Islam, and that Christian, while mentioning the Prophet (peace and blessings be upon him), insulted the Prophet (peace and blessings be upon him). This matter was brought before Sayyiduna Amr bin al-As (may Allah be pleased with him), and Sayyiduna Amr (may Allah be pleased with him) summoned them. Sayyiduna Amr (may Allah be pleased with him) said: "We have already given these people a covenant." Sayyiduna Arafah (may Allah be pleased with him) said: "Allah forbid that this covenant and pledge should be for them to harm us concerning Allah and His Messenger! We gave them a covenant that we would leave them to themselves, that they may do what they see fit in their places of worship, that we would not burden them with anything beyond their capacity, that we would fight on their behalf, and that we would not interfere between them and their religious rulings; except that when they come to us, we will judge between them according to what Allah Almighty has revealed." Then Sayyiduna Amr bin al-As (may Allah be pleased with him) said: "You have spoken the truth."
Al-Tabarani recorded it in al-Mu'jam al-Awsat. Its chain contains Abdullah bin Salih, the scribe of al-Layth; he has been declared trustworthy, and there is weakness in him. The rest of its narrators are thiqat (trustworthy).
