Types of Killing in Islam and Their Rulings
Author: Imran Ayub Lahori
❖ Types of Killing
Islamic law divides killing into three categories:
① Intentional Killing (Qatl ʿAmad)
- When a legally responsible (mukallaf) person deliberately kills someone who does not deserve death,
- Using a weapon or instrument that commonly causes death (e.g., gun, sword, arrow).
- Ruling: Qiṣāṣ (retributive execution) applies.
② Quasi-Intentional Killing (Qatl Shibh ʿAmad)
- When a person strikes another with something not normally fatal (e.g., stick, pebble, small stone),
- But the victim dies as a result.
- Ruling: Qiṣāṣ does not apply; diyah (blood money) is obligatory.
③ Accidental Killing (Qatl Khaṭaʾ)
- When a person intends to hit one target but unintentionally kills someone else.
- Example: shooting an animal while hunting, but hitting a human instead.
- Or digging a well, into which a person accidentally falls and dies.
- Ruling: Diyah is due along with kafārah (expiation), which is the freeing of one slave.

❖ General Principle
Even in Dār al-Ḥarb (non-Muslim territory at war), the rulings of qiṣāṣ and diyah apply exactly as in Dār al-Islām (Muslim territory), because the laws of Sharīʿah are binding upon Muslims everywhere.

❖ Conclusion
- Qatl ʿAmad (Intentional): Retaliatory execution (qiṣāṣ).
- Qatl Shibh ʿAmad (Quasi-intentional): Blood money (diyah).
- Qatl Khaṭaʾ (Accidental): Blood money (diyah) + expiation (kafārah).
