— A Shar‘i Perspective Based on Authentic Ahadith —
✦ 1. Permission to Offer Nafl in Masjid al-Haram (Near the Ka‘bah) During Prohibited Times
Hadith of Sayyiduna Jubayr ibn Mut‘im رضي الله عنه:
The Messenger of Allah ﷺ said:
“O Banu ‘Abd Manaf! Do not stop anyone from performing Tawaf of this House (Ka‘bah) or offering Salah at any time, day or night.”
(Tirmidhi, Book of Hajj, Hadith 868)
✔ Ruling: This Hadith clearly proves that Nafl prayers offered after Tawaf are permissible at any time, even during normally prohibited times (e.g., after Fajr or ‘Asr).
✔ The two rak‘ahs after Tawaf may be performed regardless of the time.
✦ 2. Permissibility of Making Up Missed (Qada) Prayers During Prohibited Times
Hadith of Sayyiduna Anas رضي الله عنه:
The Prophet ﷺ said:
“Whoever forgets a prayer or sleeps through it, its expiation is to perform it as soon as he remembers.”
(Bukhari, Kitab Mawāqīt as-Salah, Hadith 597; Muslim, Hadith 684)
✔ This Hadith establishes the unanimous opinion among the majority of scholars (jumhūr) that missed prayers may be made up at any time — even after Fajr or ‘Asr, which are usually times when Nafl is not allowed.
✦ 3. Fajr Prayer Missed Due to Sleep — Prophetic Example
Narration of Sayyiduna Abu Qatadah رضي الله عنه:
On a journey, the Prophet ﷺ said:
“Who will stay awake tonight to awaken us for Fajr?”
Sayyiduna Bilal رضي الله عنه volunteered, but eventually also fell asleep.
When the sun rose and its heat was felt, the Prophet ﷺ awoke and said:
“Let us move away from this place, for it is where Shaytan was.”
Upon reaching a new spot, the Prophet ﷺ instructed Bilal to call the Adhan.
He and the companions prayed two Sunnahs, followed by the Fajr (obligatory) prayer, then he said:
“Whoever forgets a prayer should pray it as soon as he remembers.”
(Bukhari, Hadith 595; Muslim, Hadith 681)
✔ Note: The narration in Sahih Muslim mentions that the Prophet ﷺ and the companions first offered two Sunnah rak‘ahs, then the Fardh.
✔ This incident occurred after sunrise, further proving that missed Fajr prayer can be offered even during prohibited time, if missed unintentionally.
✦ 4. Refutation of Fabricated Narration
A fabricated and baseless popular statement goes:
“When Bilal had not yet given the Adhan of Fajr, even the dawn did not appear.”
✔ This contradicts the authentic Hadith, where it is clearly reported that the sun had already risen when the Prophet ﷺ and the Sahabah woke up and offered the Fajr prayer.
✔ Thus, any such stories are not only unfounded, but also in opposition to the Seerah and authentic Sunnah.
✦ 5. Do Not Delay Qada Prayer Once Remembered
✔ The correct practice, as per the Prophet ﷺ’s example, is that as soon as a missed prayer is remembered or one wakes up, the Qada should be performed immediately.
✔ Waiting for the next prayer’s time is not appropriate.
✔ One should also repent, seek forgiveness, and be eager in doing righteous deeds thereafter.
✅ Key Conclusions:
① Nafl after Tawaf in Masjid al-Haram is allowed at any time.
② Missed obligatory prayers (Qada) may be performed even during prohibited times.
③ Delaying Qada until a “convenient time” is not Sunnah.
④ Prophetic practice is to offer missed prayers immediately.
⑤ Narrations that contradict these established facts should be rejected.
