❖ Question:
Respected Sir, I own the following plots:
◈ One plot in DHA City allotted to me by DHA.
◈ Another plot in DHA City, purchased on installments (so far I have paid two lakh rupees).
◈ A third plot in Taiser Town, also under installments.
◈ One more plot in Dream Valley, installments ongoing.
I have not yet received possession of any of these plots.
My intention behind buying these plots is to sell them later and construct a residential house.
The question is: Is Zakāh obligatory on these plots, even though possession has not yet been obtained, but I can sell them in the market if I wish?
❖ Answer:
Al-ḥamdu lillāh, waṣ-ṣalātu wa-s-salāmu ʿalā Rasūlillāh, ʿammā baʿd!
✦ 1. Intention and Purpose
- Since you purchased these plots with the intention of building your own residential house, they fall under the category of basic necessities of life (ḍarūriyyāt al-ḥayāt).
- According to Sharīʿah, Zakāh is not obligatory on items that are part of essential needs.
✦ 2. State of Possession and Ownership
- You do not yet have full possession of these plots.
- When one has not acquired complete possession and ownership, Zakāh does not become obligatory on such property.
✅ Conclusion:
Zakāh is not obligatory on your plots, because:
➊ They were purchased for residential need, not for trade or investment.
➋ You have not yet gained full possession and ownership.
