❖ Question
What do the scholars of Islam say regarding this case: A man named Khan Muhammad passed away, leaving behind the following heirs:
◄ Three sons
◄ One daughter
According to the Shariah of Muhammad ﷺ, how should the estate be distributed among these heirs?
❖ Answer
Al-ḥamdu lillāh, waṣ-ṣalātu was-salāmu ʿalā Rasūlillāh, Ammā Baʿd!
After the funeral and burial expenses and any debts are paid off, the remaining wealth will be divided. Assuming the total estate is 1 rupee, the division is as follows:
✿ Each son will receive 4 ānā 6 pāi.
✿ The daughter will receive 2 ānā 3 pāi.
The remaining 3 pāi will be divided into seven (7) portions:
◈ Daughter: 1 portion
◈ Each son: 2 portions
❖ Evidence
Allah ﷻ says:
﴿يُوصيكُمُ اللَّـهُ فى أَولـٰدِكُم ۖ لِلذَّكَرِ مِثلُ حَظِّ الأُنثَيَينِ﴾ [An-Nisāʾ: 11]
❖ Division in the Modern Decimal System (%)
If the estate is considered 100 rupees, then the division will be:
◈ Three sons (ʿAṣabah): 85.72 (i.e., each ≈ 28.57)
◈ One daughter (ʿAṣabah): 14.28
