Question:
I want to present my issue before you that undoubtedly I have a daughter named (A.Y.J.R). She is married to a person named (Y-R-A). He oppressed his wife (my daughter) and cursed her seventy-seven (77) times. We presented our issue to the judge of the Department of Rights for redress. When her husband admitted before the judge that he verbally abused his wife, the judge sentenced him to six days imprisonment. Then the judge, without comparing the severity of his wrongdoing with the punishment, returned his wife to him in the same condition. Therefore, I have come before you to inquire about this issue: Is it permissible for her to go back to her husband or not? Please issue a fatwa for us. May Allah reward you well.
Answer:
It is not permissible for a man to curse his wife or any other Muslim, but if he does so, his wife does not become forbidden to him; rather, she remains his wife because cursing is not a form of divorce.
However, it is obligatory upon the mentioned husband to repent and seek forgiveness for this act. Hopefully, Allah will accept our and his repentance. و بالله التوفيق وصلى الله على نبينا محمد وآله وصحبه وسلم
