Hadith 552

عَنْ مَالِكٍ ، عَنْ هِلالِ بْنِ أُسَامَةَ ، عَنْ عَطَاءِ بْنِ يَسَارٍ ، عَنْ عُمَرَ بْنِ الْحَكَمِ ، أَنَّهُ قَالَ : أَتَيْتُ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، فَقُلْتُ : يَا رَسُولَ اللَّهِ ، إِنَّ جَارِيَةً لِي كَانَتْ تَرْعَى غَنَمًا لِي فَجِئْتُهَا وَفُقِدَتْ شَاةٌ مِنَ الْغَنَمِ فَسَأَلْتُهَا عَنْهَا ، فَقَالَتْ : أَكَلَهَا الذِّئْبُ ، فَأَسِفْتُ عَلَيْهَا ، وَكُنْتُ امْرَأً مِنْ بَنِي آدَمَ فَلَطَمْتُ وَجْهَهَا وَعَلَيَّ رَقَبَةٌ أَفَأُعْتِقُهَا ؟ فَقَالَ لَهَا رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ : " أَيْنَ اللَّهُ ؟ " فَقَالَتْ : فِي السَّمَاءِ ، فَقَالَ : " مَنْ أَنَا ؟ " فَقَالَتْ : أَنْتَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، فَقَالَ : " أَعْتِقْهَا " ، فَقَالَ عُمَرُ بْنُ الْحَكَمِ : يَا رَسُولَ اللَّهِ أَشْيَاءٌ كُنَّا نَصْنَعُهَا فِي الْجَاهِلِيَّةِ : كُنَّا نَأْتِي الْكُهَّانَ ، قَالَ النَّبِيُّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ : " فَلا تَأْتُوا الْكُهَّانَ " ، فَقَالَ عُمَرُ : وَكُنَّا نَتَطَيَّرُ ، فَقَالَ : " إِنَّمَا ذَلِكَ شَيْءٌ يَجِدُهُ أَحَدُكُمْ فِي نَفْسِهِ فَلا يَصُدَّنَّكُمْ " . قَالَ أَبُو جَعْفَرٍ : سَمِعْتُ الْمُزَنِيَّ يَقُولُ : قَالَ الشَّافِعِيُّ رَحِمَهُ اللَّهُ : مَالِكُ بْنُ أَنَسٍ يُسَمِّي هَذَا الرَّجُلَ عُمَرَ بْنَ الْحَكَمِ وَإِنَّمَا هُوَ مُعَاوِيَةُ بْنُ الْحَكَمِ . قَالَ أَبُو جَعْفَرٍ : هُوَ كَمَا قَالَ الشَّافِعِيُّ رَحِمَهُ اللَّهُ . وَقَالَ أَبُو جَعْفَرٍ : مَالِكٌ يَقُولُ فِي إِسْنَادِ هَذَا الْحَدِيثِ هِلالَ بْنَ أُسَامَةَ ، وَإِنَّمَا هُوَ هِلالُ بْنُ عَلِيٍّ غَيْرَ أَنَّ قَائِلا قَالَ : هُوَ هِلالُ بْنُ عَلِيِّ بْنِ أُسَامَةَ فَإِنْ كَانَ كَذَلِكَ فَإِنَّمَا نَسَبَهُ مَالِكٌ إِلَى جَدِّهِ .
It is narrated from Sayyiduna Umar bin Hakam (may Allah be pleased with him) who says: I came to the Messenger of Allah (peace and blessings be upon him) and said: O Messenger of Allah (peace and blessings be upon him)! I have a slave girl who used to herd goats. I went to her and found that one goat was missing. I asked her about the goat, and she said that a wolf had eaten it. I was extremely saddened by this (because) I am also from the children of Adam, so I slapped her on the face. I had vowed to free a slave; should I free her? (So the slave girl was brought.) The Messenger of Allah (peace and blessings be upon him) asked her: “Tell me, where is Allah?” She replied: “In the heavens.” He (peace and blessings be upon him) then asked: “Who am I?” She said: “You are the Messenger of Allah (peace and blessings be upon him).” Upon this, he (peace and blessings be upon him) said: “Free her.” So Umar bin Hakam (may Allah be pleased with him) said: O Messenger of Allah (peace and blessings be upon him)! There are some things we used to do in the days of ignorance; we used to go to fortune-tellers. The Prophet (peace and blessings be upon him) said: “Do not go to them (after Islam).” Umar (may Allah be pleased with him) said: We used to determine fate through birds as well? He (peace and blessings be upon him) said: “This is a whisper that comes into your hearts; birds and bad omens should not prevent you from doing anything.” Imam Muzani (may Allah have mercy on him) says: Imam Shafi’i (may Allah have mercy on him) said: Imam Malik (may Allah have mercy on him) used to mention his name as Umar bin Hakam (may Allah be pleased with him), although it was Mu’awiyah bin Hakam (may Allah be pleased with him).
