بَابُ مَا جَاءَ فِيمَنْ بَدَأَ بِالْيَمِينِ فِي الطَّلَاقِ وَالْعَتَاقِ قَبْلَ الِاسْتِثْنَاءِ
Chapter on those who begin with an oath in divorce and emancipation before making an exception
Sunan Sa'id bin Mansur 2992 — on those who begin with an oath
حَدَّثَنَا سَعِيدٌ قَالَ: نا عَبْدُ اللَّهِ بْنُ الْمُبَارَكِ، عَنْ عَبْدِ الْمَلِكِ، عَنْ عَطَاءٍ، فِي رَجُلٍ قَالَ لِغُلَامِهِ: «أُعْتِقُكَ إِنْ شَاءَ اللَّهُ»، فَلَمْ يَرَهُ عِتْقًا "
Hazrat Ata (may Allah have mercy on him) said: "If someone says to his slave: I will set you free, insha'Allah, then the emancipation will not take place."
