بَابُ مَا جَاءَ فِيمَنْ بَدَأَ بِالْيَمِينِ فِي الطَّلَاقِ وَالْعَتَاقِ قَبْلَ الِاسْتِثْنَاءِ
Chapter on those who begin with an oath in divorce and emancipation before making an exception
Sunan Sa'id bin Mansur 2991 — on those who begin with an oath
حَدَّثَنَا سَعِيدٌ قَالَ: نا ابْنُ الْمُبَارَكِ، عَنْ مَعْمَرٍ، عَنِ ابْنِ طَاوُسٍ، عَنْ أَبِيهِ «أَنَّهُ كَانَ يَرَى الِاسْتِثْنَاءَ فِي الطَّلَاقِ جَائِزًا»
Hazrat Tawus (may Allah have mercy on him) considered exception (istithna) permissible in divorce.
