باب: : ولد أم الولد من غير سيدها بعد الاستيلاد.

أَخْبَرَنَا أَبُو زَكَرِيَّا بْنُ أَبِي إِسْحَاقَ، وَأَبُو بَكْرِ بْنُ الْحَسَنِ قَالَا: ثنا أَبُو الْعَبَّاسِ مُحَمَّدُ بْنُ يَعْقُوبَ، أنبأ مُحَمَّدُ بْنُ عَبْدِ اللهِ بْنِ عَبْدِ الْحَكَمِ، أنبأ ابْنُ وَهْبٍ، أَخْبَرَنِي مَخْرَمَةُ بْنُ بُكَيْرٍ، عَنْ أَبِيهِ، عَنِ ابْنِ قُسَيْطٍ أَنَّهُ سَمِعَ مُحَمَّدَ بْنَ عَبْدِ الرَّحْمَنِ بْنِ ثَوْبَانَ، أَنَّهُ سَمِعَ عَبْدَ اللهِ بْنَ عُمَرَ، يَقُولُ: " إِذَا وَلَدَتِ الْأَمَةُ مِنْ سَيِّدِهَا فَنَكَحَتْ بَعْدَ ذَلِكَ فَوَلَدَتْ أَوْلَادًا كَانَ وَلَدُهَا بِمَنْزِلَتِهَا عَبِيدًا مَا عَاشَ سَيِّدُهَا، فَإِنْ مَاتَ فَهُمْ أَحْرَارٌ ".
Sayyiduna Abdullah bin Umar (may Allah be pleased with them both) said: When a slave woman bears a child to her master, and after that she is married off and bears children, her children have the same status as her, as slaves, for as long as her master lives. If he dies, they are free.
أَخْبَرَنَا أَبُو حَامِدٍ أَحْمَدُ بْنُ عَلِيٍّ الْإِسْفَرَايِينِيُّ، أنبأ زَاهِرُ بْنُ أَحْمَدَ، ثنا أَبُو بَكْرِ بْنُ زِيَادٍ النَّيْسَابُورِيُّ، ثنا مُحَمَّدُ بْنُ عَبْدِ الْمَلِكِ، ثنا يَزِيدُ هُوَ ابْنُ هَارُونَ، ثنا إِسْمَاعِيلُ، عَنْ عَامِرٍ قَالَ: " وَلَدُ الْمُعْتَقَةِ عَنْ دُبُرٍ وَأُمِّ الْوَلَدِ بِمَنْزِلَةِ أُمِّهِمَا، إِذَا عَتَقَتْ فَهُمْ مُعْتَقُونَ، إِذَا مَاتَ السَّيِّدُ "..
Isma'il narrates from Amir (may Allah have mercy on him) that the children of a mudabbarah (a slave woman to be freed on her master's death) and the children of an umm walad have the same status (as their mothers): when their mothers are freed, their children are also freed, when the master dies.
أَخْبَرَنَا أَبُو عَبْدِ اللهِ الْحَافِظُ، أنبأ أَبُو الْوَلِيدِ، ثنا الْحَسَنُ بْنُ سُفْيَانَ، ثنا حِبَّانُ، أنبأ عَبْدُ اللهِ، عَنْ حَمَّادِ بْنِ زَيْدٍ، عَنْ أَبِي هَاشِمٍ، عَنْ إِبْرَاهِيمَ، قَالَ: " وَلَدُ الْمُدَبَّرَةِ وَأُمِّ الْوَلَدِ بِمَنْزِلَتِهِمَا ".
Ibrahim (may Allah have mercy on him) said: The children of a mudabbarah and of an umm walad have the same status as their mothers.
(b) Umar bin Abd al-Aziz (may Allah have mercy on him) said, (concerning) a man who married his umm walad to a slave and she had children: they have the same status as their mother.

أَخْبَرَنَا مُحَمَّدُ بْنُ أَبِي الْمَعْرُوفِ، أنبأ أَبُو سَعِيدٍ الرَّازِيُّ، ثنا مُحَمَّدُ بْنُ أَيُّوبَ، أنبأ مُسْلِمٌ، ثنا هِشَامٌ، ثنا قَتَادَةُ، عَنِ الْحَسَنِ، فِي أُمِّ الْوَلَدِ تَعْتِقُ وَلَهَا أَوْلَادٌ قَالَ: " تَعْتِقُ هِيَ وَأَوْلَادُهَا ".
Al-Hasan (may Allah have mercy on him) said concerning an umm walad who is freed and has children: she and her children are both free.
