أَخْبَرَنَا أَبُو عَبْدِ اللهِ الْحَافِظُ، أنبأ أَبُو الْوَلِيدِ، ثنا الْحَسَنُ بْنُ سُفْيَانَ، ثنا أَبُو بَكْرِ بْنُ أَبِي شَيْبَةَ، ثنا هُشَيْمٌ، عَنْ يُونُسَ، عَنِ الْحَسَنِ قَالَ: " جِنَايَةُ الْمُكَاتَبِ فِي رَقَبَتِهِ، يَبْدَأُ بِهَا ".
Al-Hasan (may Allah have mercy on him) said: The offence of a mukatab is his own liability, and it is to be settled first.
وَبِإِسْنَادِهِ، حَدَّثَنَا أَبُو بَكْرٍ، ثنا مُحَمَّدُ بْنُ سَوَاءٍ، عَنْ عَبَّادِ بْنِ مَنْصُورٍ، عَنْ حَمَّادٍ، عَنْ إِبْرَاهِيمَ، عَنْ شُرَيْحٍ قَالَ: " جِرَاحَتُهُ جِرَاحَةُ عَبْدٍ ".
Ibrahim (may Allah have mercy on him) narrates from Qadi Shurayh (may Allah have mercy on him) that the wounding of a mukatab is like the wounding of a slave.
قَالَ: وَحَدَّثَنَا أَبُو بَكْرٍ، عَنْ مُحَمَّدِ بْنِ سَوَاءٍ، عَنْ سَعِيدٍ، عَنْ قَتَادَةَ، عَنْ عُمَرَ رَضِيَ اللهُ عَنْهُ قَالَ: " جِرَاحَةُ الْمُكَاتَبِ جِرَاحَةُ عَبْدٍ ".
Qatadah narrates from Sayyiduna Umar (may Allah be pleased with him) that the wounding of a mukatab is like the wounding of a slave.
أَخْبَرَنَا أَبُو سَعِيدِ بْنُ أَبِي عَمْرٍو، ثنا أَبُو الْعَبَّاسِ الْأَصَمُّ، أنبأ الرَّبِيعُ، أنبأ الشَّافِعِيُّ، أنبأ عَبْدُ اللهِ بْنُ الْحَارِثِ، عَنِ ابْنِ جُرَيْجٍ، قَالَ: قَالَ عَطَاءٌ: " إِذَا أُصِيبَ الْمُكَاتَبُ لَهُ قَوَدُهُ "، وَقَالَهَا عَمْرُو بْنُ دِينَارٍ، قَالَ ابْنُ جُرَيْجٍ: مِنْ أَجْلِ أَنَّهُ كَأَنَّهُ مِنْ مَالِهِ، يُحْرِزُهُ كَمَا يُحْرِزُ مَالَهُ؟ قَالَ: " نَعَمْ ". ⦗٥٧١⦘ قَالَ الشَّافِعِيُّ رَحِمَهُ اللهُ: كَمَا قَالَ عَطَاءٌ وَعَمْرُو بْنُ دِينَارٍ: " الْجِنَايَةُ عَلَيْهِ مَالٌ مِنْ مَالِهِ، لَا يَكُونُ لِسَيِّدِهِ أَخْذُهَا بِحَالٍ، إِلَّا أَنْ يَمُوتَ قَبْلَ أَنْ يُؤَدِّيَ "..
Ibn Jurayj (may Allah have mercy on him) says that Ata' (may Allah have mercy on him) said: When a mukatab is injured, he has the right of retaliation (qisas); and Amr bin Dinar said the same. Ibn Jurayj (may Allah have mercy on him) said: Is that because it is his property, which he is responsible for safeguarding just as he safeguards his property? He said: Yes.
Imam al-Shafi'i (may Allah have mercy on him) said: It is as Ata' and Amr bin Dinar (may Allah have mercy on them both) said: The compensation for an offence against him is part of his own property; his master may not take it in any circumstance, unless he dies before paying off his contract.
