أَخْبَرَنَا أَبُو زَكَرِيَّا بْنُ أَبِي إِسْحَاقَ، وَأَبُو بَكْرٍ الْحِيرِيُّ قَالَا: ثنا أَبُو الْعَبَّاسِ مُحَمَّدُ بْنُ يَعْقُوبَ، أنبأ مُحَمَّدُ بْنُ عَبْدِ اللهِ بْنِ عَبْدِ الْحَكَمِ، أنبأ ابْنُ وَهْبٍ، أَخْبَرَنِي جَرِيرُ بْنُ حَازِمٍ، عَنْ أَيُّوبَ السَّخْتِيَانِيِّ، عَنْ نَافِعٍ، أَنَّ حَفْصَةَ، زَوْجَ النَّبِيِّ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ كَاتَبَتْ عَبْدًا لَهَا عَلَى رَقِيقٍ، قَالَ نَافِعٌ: فَأَدْرَكْتُ أَنَا ثَلَاثَةً مِنَ الَّذِينَ أَدَّوْا فِي مُكَاتَبَتِهِمْ..
Nafi' (may Allah have mercy on him) says that Sayyidah Hafsah (may Allah be pleased with her), the wife of the Prophet (peace and blessings be upon him), made a contract of manumission (mukatabah) with a slave of hers in exchange for slaves. Nafi' (may Allah have mercy on him) says: I myself met three of those who were paid in their contract of manumission.
وَأَخْبَرَنَا أَبُو عَبْدِ اللهِ الْحَافِظُ، أنبأ أَبُو الْوَلِيدِ، ثنا الْحَسَنُ بْنُ سُفْيَانَ، ثنا أَبُو بَكْرٍ هُوَ ابْنُ أَبِي شَيْبَةَ، ثنا عَبَّادُ بْنُ الْعَوَّامِ، عَنْ مُحَمَّدِ بْنِ إِسْحَاقَ، عَنْ نَافِعٍ، عَنِ ابْنِ عُمَرَ، أَنَّهُ كَانَ لَا يَرَى بَأْسًا بِالْكِتَابَةِ عَلَى الْوُصَفَاءِ..
Nafi' narrates from Ibn Umar (may Allah be pleased with them both) that he saw no harm in a contract of manumission (mukatabah) in exchange for young slaves.
وَقَالَ: وَحَدَّثَنَا أَبُو بَكْرٍ، ثنا وَكِيعٌ، عَنْ حَمَّادِ بْنِ زَيْدٍ، عَنْ عَبْدِ اللهِ بْنِ أَبِي بَكْرِ بْنِ أَنَسٍ قَالَ: هَذِهِ مُكَاتَبَةُ سِيرِينَ عِنْدَنَا: " هَذَا مَا كَاتَبَ أَنَسُ بْنُ مَالِكٍ غُلَامَهُ سِيرِينَ، كَاتَبَهُ عَلَى كَذَا وَكَذَا أَلْفًا، وَعَلَى غُلَامَيْنِ يَعْمَلَانِ مِثْلَ عَمَلِهِ "..
Abdullah bin Abi Bakr bin Anas (may Allah have mercy on him) says: The contract of manumission (mukatabah) of Sirin is with us: this is the contract that Anas bin Malik (may Allah be pleased with him) made with his slave Sirin, for so many thousand and two slaves, who would do the same kind of work (as he did).
وَأَخْبَرَنَا أَبُو زَكَرِيَّا، وَأَبُو بَكْرٍ قَالَا: ثنا أَبُو الْعَبَّاسِ، أنبأ مُحَمَّدُ بْنُ عَبْدِ اللهِ، أنبأ ابْنُ وَهْبٍ، أَخْبَرَنِي مَسْلَمَةُ بْنُ عُلَيٍّ، وَغَيْرُ وَاحِدٍ، أَنَّ الْأَوْزَاعِيَّ حَدَّثَهُمْ أَنَّ عَطَاءَ بْنَ أَبِي رَبَاحٍ قَالَ: قَالَ ابْنُ عَبَّاسٍ فِي رَجُلٍ كَاتَبَ عَبْدًا لَهُ عَلَى ثَلَاثَةِ وُصَفَاءَ: " إِنَّهُ لَا بَأْسَ بِذَلِكَ ". قَالَ الْأَوْزَاعِيُّ: وَقَالَ ابْنُ شِهَابٍ مِثْلَهُ.
Ata' bin Abi Rabah (may Allah have mercy on him) says that Sayyiduna Ibn Abbas (may Allah be pleased with them both) said regarding a man who made a contract of manumission (mukatabah) with his slave in exchange for three young slaves: There is no harm in that.
