باب: الجد والأخ إذا اجتمعا.

أَخْبَرَنَا أَبُو عَبْدِ اللهِ الْحَافِظُ، أنبأ أَبُو الْوَلِيدِ، ثنا عَبْدُ اللهِ بْنُ مُحَمَّدٍ، ثنا مُحَمَّدُ بْنُ يَحْيَى، ثنا مُحَمَّدُ بْنُ يُوسُفَ، ثنا سُفْيَانُ، عَنِ ابْنِ جُرَيْجٍ، عَنْ عَطَاءٍ، فِي رَجُلٍ مَاتَ وتَرَكَ أَخَاهُ وَجَدَّهُ، قَالَ: " الْوَلَاءُ بَيْنَ الْجَدِّ وَالْأَخِ ".
Ibn Jurayj (may Allah have mercy on him) narrates from Ata (may Allah have mercy on him), concerning a man who died leaving a brother and a grandfather, that the wala' is shared between the grandfather and the brother.
وَأَخْبَرَنَا أَبُو عَبْدِ اللهِ، أنبأ أَبُو الْوَلِيدِ، ثنا عَبْدُ اللهِ بْنُ مُحَمَّدٍ، قَالَ: قَالَ أَبُو عَبْدِ اللهِ: ثنا مُحَمَّدُ بْنُ يَحْيَى، ثنا أَبُو الْمُغِيرَةِ، ثنا أَبُو بَكْرٍ، حَدَّثَنِي مَكْحُولٌ، وَرَاشِدٌ، وَضَمْرَةُ، وَعَطِيَّةُ، عَنْ زَيْدِ بْنِ ثَابِتٍ، قَالَ: " الْجَدُّ أَوْلَى مِنَ ابْنِ الْأَخِ وَالْعَمِّ، وَالنَّاسُ عَلَى ذَلِكَ ".
Sayyiduna Zayd bin Thabit (may Allah be pleased with him) said: The grandfather is more entitled than the nephew and the paternal uncle, and this is what people practise.
