أَخْبَرَنَا أَبُو عَبْدِ اللهِ الْحَافِظُ، أنبأ أَبُو الْوَلِيدِ الْفَقِيهُ، أنبأ الْحَسَنُ بْنُ سُفْيَانَ، ثنا أَبُو بَكْرٍ، ثنا وَكِيعٌ، عَنْ إِسْرَائِيلَ، عَنْ جَابِرٍ، عَنْ مَسْرُوقٍ، وَشُرَيْحٍ، أَنَّهُمَا قَالَا: " لَا تَجُوزُ شَهَادَةٌ عَلَى شَهَادَةٍ فِي حَدٍّ، وَلَا يُكْفَلُ فِي حَدٍّ ".
Jabir (may Allah have mercy on him) narrates from Masruq and Shurayh (may Allah have mercy on them both) that testimony upon testimony is not permissible in the hudud (prescribed punishments), nor is a surety (kafalah) accepted in a hadd.
قَالَ: وَحَدَّثَنَا الْحَسَنُ بْنُ سُفْيَانَ، ثنا أَبُو بَكْرٍ، ثنا حُمَيْدُ بْنُ عَبْدِ الرَّحْمَنِ، عَنْ حَسَنٍ، عَنْ لَيْثٍ، عَنْ عَطَاءٍ، وَطَاوُسٍ، قَالَا: " لَا تَجُوزُ شَهَادَةٌ عَلَى شَهَادَةٍ فِي حَدٍّ ". وَرُوِّينَا عَنِ الشَّعْبِيِّ وَإِبْرَاهِيمَ، وَقَدْ مَضَتِ الْأَخْبَارُ فِيهِ فِي دَرْءِ الْحُدُودِ بِالشُّبُهَاتِ فِي كِتَابِ الْحُدُودِ.
Layth (may Allah have mercy on him) narrates from Ata (may Allah have mercy on him) and Tawus (may Allah have mercy on him) that testimony upon testimony is not permissible in the hudud (prescribed punishments).
