أَخْبَرَنَا أَبُو حَازِمٍ الْحَافِظُ، أنبأ أَبُو الْفَضْلِ بْنُ خِمَيْرَوَيْهِ، ثنا أَحْمَدُ بْنُ نَجْدَةَ، ثنا سَعِيدُ بْنُ مَنْصُورٍ، ثنا هُشَيْمٌ، أنبأ الشَّيْبَانِيُّ، عَنِ الشَّعْبِيِّ، أَنَّ شُرَيْحًا كَانَ يُجِيزُ شَهَادَةَ الْأَخِ لِأَخِيهِ إِذَا كَانَ عَدْلًا "،.
Al-Sha'bi (may Allah have mercy on him) said that Qadi Shurayh (may Allah have mercy on him) used to accept a brother's testimony in favour of his brother when he was upright ('adl).
قَالَ: وَحَدَّثَنَا سَعِيدٌ، ثنا خَالِدُ بْنُ عَبْدِ اللهِ، عَنْ مُحَمَّدِ بْنِ عَمْرِو بْنِ عَلْقَمَةَ، عَنْ عُمَرَ بْنِ عَبْدِ الْعَزِيزِ، أَنَّهُ أَجَازَ شَهَادَةَ الْأَخِ لِأَخِيه، وَرُوِّينَا، عَنْ أَبِي يَحْيَى السَّاجِيِّ أَنَّهُ رَوَاهُ، عَنِ ابْنِ الزُّبَيْرِ، وَشُرَيْحٍ، وَالْحَسَنِ، وَالشَّعْبِيِّ، وَعُمَرَ بْنِ عَبْدِ الْعَزِيزِ. قَالَ: وَقَالَ الْحَسَنُ وَالزُّهْرِيُّ: " تَجُوزُ شَهَادَةُ الزَّوْجِ وَالْمَرْأَةِ ".
Umar bin Abd al-Aziz (may Allah have mercy on him) considered a brother's testimony in favour of his brother to be permissible.
