Book of the Etiquette of the Judge
باب: مسألة القاضي عن أحوال الشهود ففي الناس بر وفاجر وأمين وخائن، وقد قال الله تعالى: ممن ترضون من الشهداء
The judge inquiring about the condition of witnesses, for among people are righteous and wicked, trustworthy and treacherous; and Allah the Exalted said: Of those you approve as witnesses

قَالَ اللهُ تَعَالَى: {مِمَّنْ تَرْضَوْنَ مِنَ الشُّهَدَاءِ} [البقرة: 282].
Allah Almighty says: "From among those witnesses whom you approve of." [Surah al-Baqarah: 282]
أَخْبَرَنَا أَبُو عَبْدِ اللهِ الْحَافِظُ، وَأَبُو سَعِيدِ بْنُ أَبِي عَمْرٍو قَالَا: ثنا أَبُو الْعَبَّاسِ مُحَمَّدُ بْنُ يَعْقُوبَ، ثنا الْعَبَّاسُ بْنُ مُحَمَّدٍ الدُّورِيُّ، ثنا أَبُو دَاوُدَ الْحَفَرِيُّ، عَنْ سُفْيَانَ الثَّوْرِيِّ، عَنِ الْأَعْمَشِ ح وَأنبأ أَبُو صَالِحِ بْنُ أَبِي طَاهِرٍ الْعَنْبَرِيُّ، أنبأ جَدِّي يَحْيَى بْنُ مَنْصُورٍ الْقَاضِي، ثنا أَحْمَدُ بْنُ سَلَمَةَ، ثنا إِسْحَاقُ بْنُ إِبْرَاهِيمَ، أنبأ عِيسَى بْنُ يُونُسَ، عَنِ الْأَعْمَشِ، عَنْ زَيْدِ بْنِ وَهْبٍ، عَنْ حُذَيْفَةَ، رَضِيَ اللهُ عَنْهُ قَالَ: حَدَّثَنَا رَسُولُ اللهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ بِحَدِيثَيْنِ، وَقَدْ رَأَيْتُ أَحَدَهُمَا، وَأَنَا أَنْتَظِرُ الْآخَرَ، حَدَّثَنَا: " أَنَّ الْأَمَانَةَ نَزَلَتْ فِي جَذْرِ قُلُوبِ الرِّجَالِ، فَنَزَلَ الْقُرْآنُ، فَعَلِمُوا مِنَ الْقُرْآنِ، وَعَلِمُوا مِنَ السُّنَّةِ، ثُمَّ حَدَّثَنَا عَنَ رَفْعِهَا فَقَالَ: " يَنَامُ الرَّجُلُ نَوْمَةً، فَتُقْبَضُ الْأَمَانَةُ مِنْ قَلْبِهِ، فَيَبْقَى أَثَرُهَا مِثْلَ أَثَرِ الْوَكْتِ، ثُمَّ يَنَامُ الرَّجُلُ نَوْمَةً، فَتُقْبَضُ الْأَمَانَةُ مِنْ قَلْبِهِ، فَيَبْقَى أَثَرُهَا مِثْلَ أَثَرِ الْمَجْلِ، كَجَمْرٍ دَحْرَجْتَهُ عَلَى رِجْلِكَ، فَنَفِطَ فَتَرَاهُ مُنْتَبِرًا، وَلَيْسَ فِيهِ شَيْءٌ، فَيُصْبِحُ النَّاسُ يَتَبَايَعُونَ وَلَا يَكَادُ أَحَدٌ يُؤَدِّي، حَتَّى يُقَالَ: إِنَّ فِي بَنِي فُلَانٍ رَجُلًا أَمِينًا، وَحَتَّى يُقَالَ لِرَجُلٍ: مَا أَجْلَدَهُ وَأَظْرَفَهُ وَأَعْقَلَهُ وَلَيْسَ فِي قَلْبِهِ مِثْقَالُ حَبَّةِ خَرْدَلٍ مِنْ خَيْرٍ "، ⦗٢٠٩⦘ قَالَ حُذَيْفَةُ رَضِيَ اللهُ عَنْهُ: وَلَقَدْ أَتَى عَلَيَّ زَمَانٌ، وَمَا أُبَالِي أَيُّكُمْ بَايَعْتُهُ، لَئِنْ كَانَ مُؤْمِنًا لَيَرُدَّنَّ عَلَيَّ دِينُهُ، وَلَئِنْ كَانَ يَهُودِيًّا أَوْ نَصْرَانِيًّا لَيَرُدَّنَّ عَلَيَّ سَاعِيهِ، فَأَمَّا الْيَوْمُ، فَمَا كُنْتُ أُبَايِعُ إِلَّا فُلَانًا وَفُلَانًا. لَفْظُ حَدِيثِ أَبِي صَالِحٍ رَوَاهُ الْبُخَارِيُّ فِي الصَّحِيحِ عَنْ مُحَمَّدِ بْنِ كَثِيرٍ عَنْ سُفْيَانَ، وَرَوَاهُ مُسْلِمٌ عَنْ إِسْحَاقَ بْنِ إِبْرَاهِيمَ.
Sayyiduna Hudhayfah (may Allah be pleased with him) said: The Messenger of Allah (peace and blessings be upon him) narrated two hadiths to me. One of them I have seen, and I am waiting for the other. He (peace and blessings be upon him) narrated: "Trustworthiness (amanah) descended into the hearts of men; the Qur'an was revealed, and they learned the Qur'an and learned the Sunnah." Then he spoke about its being taken away. He (peace and blessings be upon him) said: "A man will sleep, and trustworthiness will be taken from his heart, and only a trace of it will remain. Then the man will sleep, and trustworthiness will be taken from his heart, and only a mark like a blister on the skin will remain, as if an ember had fallen on your foot and made the skin swell, while there is nothing inside it. In the morning people will buy and sell with one another, but not one of them will fulfil the trust, until it will be said: In such-and-such tribe there lives a trustworthy man; and until it will be said of a man: How resolute and intelligent he is! while there is not even a speck of good in his heart." Sayyiduna Hudhayfah (may Allah be pleased with him) said: There came a time upon me when I did not care with whom I traded: if he was a believer, his religion would return (my due) to me, and if he was a Jew or a Christian, his overseer would return it to me. But today I trade only with so-and-so and so-and-so.
حَدَّثَنَا أَبُو مُحَمَّدٍ عَبْدُ اللهِ بْنُ يُوسُفَ الْأَصْبَهَانِيُّ، أنبأ أَبُو بَكْرٍ مُحَمَّدُ بْنُ الْحُسَيْنِ بْنِ الْحَسَنِ الْقَطَّانُ، أنبأ عَلِيُّ بْنُ الْحَسَنِ الْهِلَالِيُّ، ثنا يَحْيَى بْنُ حَمَّادٍ، ثنا أَبُو عَوَانَةَ، عَنْ بَيَانٍ، عَنْ قَيْسٍ هُوَ ابْنُ أَبِي حَازِمٍ، عَنْ مِرْدَاسٍ الْأَسْلَمِيِّ رَضِيَ اللهُ عَنْهُ، عَنِ النَّبِيِّ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ قَالَ: " يَذْهَبُ الصَّالِحُونَ، الْأَوَّلُ فَالْأَوَّلُ، وَيَبْقَى حُفَالَةٌ مِثْلُ حُفَالَةِ الشَّعِيرِ أَوِ التَّمْرِ وَلَا يُبَالِيهِمُ اللهُ بَالًا ". رَوَاهُ الْبُخَارِيُّ فِي الصَّحِيحِ، عَنْ يَحْيَى بْنِ حَمَّادٍ.
Sayyiduna Mirdas al-Aslami (may Allah be pleased with him) narrates from the Prophet (peace and blessings be upon him) that he (peace and blessings be upon him) said: "The righteous will depart. What remains will be dregs, like the husks of barley or dates, that is, worthless and inferior things. And Allah will pay them no heed."
أَخْبَرَنَا أَبُو عَبْدِ اللهِ الْحَافِظُ، ثنا أَبُو الْعَبَّاسِ مُحَمَّدُ بْنُ يَعْقُوبَ، ثنا الْعَبَّاسُ بْنُ مُحَمَّدٍ الدُّورِيُّ، ثنا مُحَاضِرٌ، ثنا الْأَعْمَشُ، عَنْ إِبْرَاهِيمَ، عَنْ عَبِيْدَةَ، قَالَ: قَالَ عَبْدُ اللهِ: قَالَ رَسُولُ اللهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ: " خَيْرُ النَّاسِ قَرْنِي، ثُمَّ الَّذِينَ يَلُونَهُمْ ثُمَّ الَّذِينَ يَلُونَهُمْ، ثُمَّ يَجِيءُ قَوْمٌ، تَسْبِقُ أَيْمَانُهُمْ شَهَادَتَهُمْ، وَشَهَادَتُهُمْ أَيْمَانَهُمْ " أَخْرَجَهُ الْبُخَارِيُّ مِنْ وَجْهٍ آخَرَ عَنِ الْأَعْمَشِ.
Sayyiduna Abdullah (may Allah be pleased with him) said that the Messenger of Allah (peace and blessings be upon him) said: "The best people are those of my generation, then those who follow them, then those who come after them. Then a people will come whose oaths will outstrip their testimony, and whose testimony will outstrip their oaths."
أَخْبَرَنَا أَبُو الْحَسَنِ عَلِيُّ بْنُ أَحْمَدَ بْنِ عَبْدَانَ، أنبأ أَبُو بَكْرٍ مُحَمَّدُ بْنُ أَحْمَدَ بْنِ مَحْمَوَيْهِ الْعَسْكَرِيُّ، ثنا جَعْفَرُ بْنُ مُحَمَّدٍ الْقَلَانِسِيُّ، ثنا آدَمُ بْنُ أَبِي إِيَاسٍ، ثنا شُعْبَةُ، ثنا أَبُو جَمْرَةَ، قَالَ: سَمِعْتُ زَهْدَمَ بْنَ مُضَرِّبٍ يَقُولُ: سَمِعْتُ عِمْرَانَ بْنِ حُصَيْنٍ ⦗٢١٠⦘ رَضِيَ اللهُ عَنْهُ يَقُولُ: قَالَ رَسُولُ اللهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ: " خَيْرُكُمْ قَرْنِي، ثُمَّ الَّذِينَ يَلُونَهُمْ، ثُمَّ الَّذِينَ يَلُونَهُمْ ثُمَّ الَّذِينَ يَلُونَهُمْ " قَالَ عِمْرَانُ بْنُ حُصَيْنٍ: لَا أَدْرِي أَذَكَرَ رَسُولُ اللهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ بَعْدَ قَرْنِهِ قَرْنَيْنِ أَوْ ثَلَاثَةً ثُمَّ قَالَ رَسُولُ اللهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ: " إِنَّ بَعْدَكُمْ قَوْمًا، يَخُونُونَ وَلَا يُؤْتَمَنُونَ، وَيَشْهَدُونَ وَلَا يُسْتَشْهَدُونَ، وَيَنْذِرُونَ وَلَا يَفُونَ وَيَظْهَرُ فِيهِمُ السِّمَنُ " رَوَاهُ الْبُخَارِيُّ فِي الصَّحِيحِ عَنْ آدَمَ، وَأَخْرَجَهُ مُسْلِمٌ مِنْ أَوْجُهٍ أُخَرَ عَنْ شُعْبَةَ.
Sayyiduna Imran bin Husayn (may Allah be pleased with him) said that the Messenger of Allah (peace and blessings be upon him) said: "The best of you is my generation, then those who come after it, then those who come after them, then those who adjoin them." Imran bin Husayn (may Allah be pleased with him) said: I do not know whether he (peace and blessings be upon him) mentioned two or three generations after his own. Then the Messenger of Allah (peace and blessings be upon him) said: "After you there will be treacherous, dishonest people. They will give testimony though their testimony is not sought, they will make vows but not fulfil them, and obesity will appear among them."
