أَخْبَرَنَا أَبُو زَكَرِيَّا بْنُ أَبِي إِسْحَاقَ، ثنا أَبُو الْعَبَّاسِ مُحَمَّدُ بْنُ يَعْقُوبَ، أنبأ الرَّبِيعُ بْنُ سُلَيْمَانَ، أنبأ الشَّافِعِيُّ، أنبأ مَالِكٌ، عَنْ سُهَيْلِ بْنِ أَبِي صَالِحٍ، عَنْ أَبِيهِ، عَنْ أَبِي هُرَيْرَةَ، أَنَّ سَعْدًا، قَالَ: يَا رَسُولَ اللهِ أَرَأَيْتَ إِنْ وَجَدْتُ مَعَ امْرَأَتِي رَجُلًا أُمْهِلُهُ حَتَّى آتِيَ بِأَرْبَعَةِ شُهَدَاءَ؟ فَقَالَ رَسُولُ اللهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ: " نَعَمْ " أَخْرَجَهُ مُسْلِمٌ فِي الصَّحِيحِ مِنْ حَدِيثِ مَالِكٍ كَمَا مَضَى.
Abu Hurayrah (may Allah be pleased with him) says that Sayyiduna Sa'd (may Allah be pleased with him) said: "O Messenger of Allah (peace and blessings be upon him)! If I find someone with my wife, should I leave him and look for four witnesses?" He said: "Yes."
أَخْبَرَنَا أَبُو عَبْدِ اللهِ الْحَافِظُ، أَخْبَرَنِي أَبُو الْحُسَيْنِ بْنُ يَعْقُوبَ الْحَافِظُ، ثنا مُحَمَّدُ بْنُ إِسْحَاقَ الثَّقَفِيُّ، ثنا قُتَيْبَةُ بْنُ سَعِيدٍ، ثنا عَبْدُ الْعَزِيزِ بْنُ مُحَمَّدٍ، عَنْ سُهَيْلٍ، عَنْ أَبِيهِ، عَنْ أَبِي هُرَيْرَةَ، أَنَّ سَعْدَ بْنَ عُبَادَةَ الْأَنْصَارِيَّ قَالَ: يَا رَسُولَ اللهِ الرَّجُلُ يَجِدُ مَعَ امْرَأَتِهِ رَجُلًا أَيَقْتُلُهُ؟ قَالَ رَسُولُ اللهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ: " لَا " قَالَ سَعْدٌ: بَلَى وَالَّذِي أَكْرَمَكَ بِالْحَقِّ، فَقَالَ رَسُولُ اللهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ: " اسْمَعُوا إِلَى مَا يَقُولُ سَيِّدُكُمْ " ⦗٥٨٥⦘ رَوَاهُ مُسْلِمٌ فِي الصَّحِيحِ عَنْ قُتَيْبَةَ بْنِ سَعِيدٍ.
It is narrated from Sayyiduna Abu Hurayrah (may Allah be pleased with him) that Sayyiduna Sa'd bin Ubadah al-Ansari (may Allah be pleased with him) said: "O Messenger of Allah! A man finds another man with his wife; should he kill him?" The Messenger of Allah (peace and blessings be upon him) said: "No." Sa'd said: "Rather yes, by the One who honoured you with the truth!" So the Messenger of Allah (peace and blessings be upon him) said: "Listen to what your chief is saying."
أَخْبَرَنَا مُحَمَّدُ بْنُ عَبْدِ اللهِ الْحَافِظُ، أَخْبَرَنِي أَبُو عَمْرِو بْنُ أَبِي جَعْفَرٍ، وَأَبُو بَكْرِ بْنُ عَبْدِ اللهِ، قَالَا: أنبأ الْحَسَنُ بْنُ سُفْيَانَ، ثنا أَبُو بَكْرِ بْنُ أَبِي شَيْبَةَ، ثنا عَبْدَةُ بْنُ سُلَيْمَانَ، عَنْ سُلَيْمَانَ الْأَعْمَشِ، عَنْ إِبْرَاهِيمَ، عَنْ عَلْقَمَةَ، عَنْ عَبْدِ اللهِ، قَالَ: بَيْنَمَا نَحْنُ فِي الْمَسْجِدِ لَيْلَةَ الْجُمُعَةِ إِذْ قَالَ رَجُلٌ: لَوْ أَنَّ رَجُلًا وَجَدَ مَعَ امْرَأَتِهِ رَجُلًا فَقَتَلَهُ قَتَلْتُمُوهُ، وَإِنْ تَكَلَّمَ بِهِ جَلَدْتُمُوهُ، لَأَذْكُرَنَّ ذَلِكَ لِرَسُولِ اللهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ، قَالَ: فَذَكَرَهُ لِلنَّبِيِّ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ، فَأَنْزَلَ اللهُ عَزَّ وَجَلَّ آيَاتِ اللِّعَانِ، ثُمَّ جَاءَ الرَّجُلُ فَقَذَفَ امْرَأَتَهُ، فَلَاعَنَ رَسُولُ اللهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ بَيْنَهُمَا وَقَالَ: " عَسَى أَنْ تَجِيءَ بِهِ أَسْوَدَ جَعْدًا "، فَجَاءَتْ بِهِ أَسْوَدَ جَعْدًا رَوَاهُ مُسْلِمٌ فِي الصَّحِيحِ عَنْ أَبِي بَكْرِ بْنِ أَبِي شَيْبَةَ.
Sayyiduna Abdullah (may Allah be pleased with him) says: We were sitting in the mosque on the night of Friday when a man came and began saying: "If I find someone with my wife and kill him, you will kill me; if I accuse her, you will impose the punishment for false accusation (hadd al-qadhf). I will go and tell the Prophet (peace and blessings be upon him) about this." So he came to the Prophet (peace and blessings be upon him) and mentioned this, and the verse of li'an was revealed. Then a man came and accused his wife, so he (peace and blessings be upon him) had them perform li'an between them and said: "She will give birth to a black child with curly hair." Then she gave birth to just such a child.
أَخْبَرَنَا أَبُو أَحْمَدَ الْمِهْرِجَانِيُّ، أنبأ أَبُو بَكْرِ بْنُ جَعْفَرٍ الْمُزَكِّي، ثنا مُحَمَّدُ بْنُ إِبْرَاهِيمَ، ثنا ابْنُ بُكَيْرٍ، ثنا مَالِكٌ، عَنْ يَحْيَى بْنِ سَعِيدٍ، عَنْ سَعِيدِ بْنِ الْمُسَيِّبِ، أَنَّ رَجُلًا مِنْ أَهْلِ الشَّامِ يُقَالُ لَهُ: ابْنُ خَيْبَرِيٍّ، وَجَدَ مَعَ امْرَأَتِهِ رَجُلًا فَقَتَلَهُ، أَوْ فَقَتَلَهُمَا، فَأُشْكِلَ عَلَى مُعَاوِيَةَ الْقَضَاءُ، فَكَتَبَ مُعَاوِيَةُ إِلَى أَبِي مُوسَى الْأَشْعَرِيِّ يَسْأَلُ لَهُ عَلِيَّ بْنَ أَبِي طَالِبٍ رَضِيَ اللهُ عَنْهُ عَنْ ذَلِكَ، فَسَأَلَ أَبُو مُوسَى عَنْ ذَلِكَ عَلِيَّ بْنَ أَبِي طَالِبٍ، قَالَ عَلِيٌّ: إِنَّ هَذَا لَشَيْءٌ لَمْ يَكُنْ بِأَرْضِي، عَزَمْتُ عَلَيْكَ لَتُخْبِرَنِّي، فَقَالَ أَبُو مُوسَى: كَتَبَ إِلِيَّ مُعَاوِيَةُ بْنُ أَبِي سُفْيَانَ فِي ذَلِكَ، فَقَالَ عَلِيٌّ رَضِيَ اللهُ عَنْهُ: أَنَا أَبُو حَسَنٍ، " إِنْ لَمْ يَأْتِ بِأَرْبَعَةِ شُهَدَاءَ فَلْيُعْطَ بِرُمَّتِهِ ".
Sa'id bin al-Musayyab (may Allah have mercy on him) says that someone from the people of Sham saw another man with his wife and killed them both. Sayyiduna Mu'awiyah (may Allah be pleased with him) was greatly troubled over this judgement, so he wrote about it to Sayyiduna Abu Musa al-Ash'ari (may Allah be pleased with him), asking him to put the question to Sayyiduna Ali (may Allah be pleased with him). Sayyiduna Ali (may Allah be pleased with him) said: "This is something that is not in our land." He said: "Mu'awiyah (may Allah be pleased with him) has asked me." Sayyiduna Ali (may Allah be pleased with him) replied: "I, Abu al-Hasan, say: if he does not bring four witnesses, then retaliation (qisas) is to be taken from him."
وَأَمَّا الْأَثَرُ الَّذِي أَخْبَرَنَاهُ أَبُو الْحُسَيْنِ بْنُ بِشْرَانَ، بِبَغْدَادَ، أنبأ أَبُو جَعْفَرٍ مُحَمَّدُ بْنُ عَمْرٍو الرَّزَّازُ، ثنا جَعْفَرُ بْنُ مُحَمَّدِ بْنِ شَاكِرٍ، ثنا عَفَّانُ بْنُ مُسْلِمٍ، ثنا حَمَّادُ بْنُ سَلَمَةَ، ثنا ثَابِتٌ، وَحُمَيْدٌ، وَمَطَرٌ، وَعَبَّادُ بْنُ مَنْصُورٍ، عَنْ عَبْدِ اللهِ بْنِ عُبَيْدِ بْنِ عُمَيْرٍ، أَنَّ رَجُلًا كَانَ مِنَ الْعَرَبِ نَزَلَ عَلَيْهِ نَفَرٌ فَذَبَحَ لَهُمْ شَاةً، وَلَهُ ابْنَتَانِ فَقَالَ لِإِحْدَاهُمَا: اذْهَبِي فَاحْتَطِبِي، قَالَ: فَذَهَبَتْ فَلَمَّا تَبَاعَدَتْ تَبِعَهَا أَحَدُهُمْ فَرَاوَدَهَا عَنْ نَفْسِهَا فَقَالَتِ: اتَّقِ اللهَ، وَنَاشَدَتْهُ فَأَبَى عَلَيْهَا، فَقَالَتْ: رُوَيْدَكَ حَتَّى أَسْتَصْلِحَ لَكَ، فَذَهَبَتْ وَنَامَ، فَجَاءَتْ بِصَخْرَةٍ فَفَلَقَتْ رَأْسَهُ فَقَتَلَتْهُ، فَجَاءَتْ إِلَى أَبِيهَا فَأَخْبَرَتْهُ الْخَبَرَ، فَقَالَ: اسْكُتِي، لَا تُخْبِرِي أَحَدًا، فَهَيَّأَ الطَّعَامَ فَوَضَعَهُ بَيْنَ يَدَيْ أَصْحَابِهِ فَقَالَ لِأَصْحَابِهِ: كُلُوا، فَقَالُوا: حَتَّى يَجِيءَ صَاحِبُنَا، فَقَالَ: كُلُوا، فَإِنَّهُ سَيَأْتِيكُمْ، فَلَمَّا أَكَلُوا حَمِدَ اللهَ وَأَثْنَى عَلَيْهِ وَقَالَ: إِنَّهُ كَانَ مِنَ الْأَمْرِ كَيْتَ ⦗٥٨٦⦘ وَكَيْتَ، فَقَالُوا: يَا عَدُوَّ اللهِ قَتَلْتَ صَاحِبَنَا، وَاللهِ لَنَقْتُلَنَّكَ بِهِ، فَارْتَفَعُوا إِلَى عُمَرَ رَضِيَ اللهُ عَنْهُ فَقَالَ: " مَا كَانَ اسْمُ صَاحِبِكُمْ؟ " فَقَالُوا: غَفَلٌ، قَالَ: " هُوَ كَاسْمِهِ، وَأَبْطَلَ دَمَهُ " فَهَذَا مُرْسَلٌ.
Abdullah bin Ubayd bin Umayr (may Allah have mercy on him) says: Some people from among the Arabs came to a man who had two daughters. He slaughtered a goat and told one of his daughters to gather firewood. When she went, one of those guests followed her; the girl sensed danger and began saying: "Fear Allah," and adjured him, but he refused. Then she said: "Wait, so that I may make myself ready for you." She went away and the man fell asleep. In the hours of the night the girl brought a rock, crushed the man's head and killed him, then came to her father and told him the whole matter. Her father said: "Keep quiet, do not tell anyone. Serve the food." He said to them: "Eat." The guests said: "Let our companion come." He said: "You eat; he will come." When they had eaten and praised Allah, he told them the whole matter. They began saying: "O enemy of Allah! You have killed our companion; we will kill you." So they brought him to Sayyiduna Umar bin al-Khattab (may Allah be pleased with him). Sayyiduna Umar bin al-Khattab (may Allah be pleased with him) asked: "What was his name?" They said: "Ghafal (heedless)." He said: "He was like his name," and he declared his blood to be of no account.

وَقَدْ أَخْبَرَنَا أَبُو الْحُسَيْنِ بْنُ بِشْرَانَ، بِبَغْدَادَ، أنبأ أَبُو جَعْفَرٍ الرَّزَّازُ، وَإِسْمَاعِيلُ بْنُ مُحَمَّدٍ الصَّفَّارُ، قَالَا: ثنا سَعْدَانُ بْنُ نَصْرٍ، ثنا سُفْيَانُ بْنُ عُيَيْنَةَ، عَنِ الزُّهْرِيِّ، عَنِ الْقَاسِمِ بْنِ مُحَمَّدٍ، عَنْ عُبَيْدِ بْنِ عُمَيْرٍ، أَنَّ رَجُلًا أَضَافَ نَاسًا مِنْ هُذَيْلٍ، فَذَهَبَتْ جَارِيَةٌ لَهُمْ تَحْتَطِبُ فَأَرَادَهَا رَجُلٌ مِنْهُمْ عَنْ نَفْسِهَا، فَرَمَتْهُ بِفِهْرٍ فَقَتَلَتْهُ، فَرُفِعَ ذَلِكَ إِلَى عُمَرَ رَضِيَ اللهُ عَنْهُ قَالَ: " ذَاكَ قَتِيلٌ اللهِ وَاللهِ لَا يُودَى أَبَدًا ".
Ubayd bin Umayr (may Allah have mercy on him) says that a man hosted some people from Hudhayl. A slave girl of theirs went to gather firewood, and one of their men tried to seduce her. She struck him with a stone and killed him. The matter was brought to Sayyiduna Umar (may Allah be pleased with him), and he said: "That one was slain by Allah; by Allah, blood money will never be paid for him."
أَخْبَرَنَا أَبُو سَعِيدِ بْنُ أَبِي عَمْرٍو، ثنا أَبُو الْعَبَّاسِ الْأَصَمُّ، أنبأ الرَّبِيعُ، قَالَ: قَالَ الشَّافِعِيُّ: هَذَا عِنْدَنَا مِنْ عُمَرَ رَضِيَ اللهُ عَنْهُ أَنَّ الْبَيِّنَةَ قَامَتْ عِنْدَهُ عَلَى الْمَقْتُولِ، أَوْ عَلَى أَنَّ وَلِيَّ الْمَقْتُولِ أَقَرَّ عِنْدَهُ بِمَا يُوجِبُ لَهُ أَنْ يَقْتُلَ الْمَقْتُولَ.
Imam al-Shafi'i (may Allah have mercy on him) says: This judgement of Sayyiduna Umar (may Allah be pleased with him) is also held by us, in that proof had been established against the slain man and his guardian had accepted the reason for the killing.
