Sayyiduna Zayd bin Thabit (may Allah be pleased with him) says that the 'aqilah (paternal kin) do not pay, and the blood money is not spread over them, except for a third of the blood money or more.
So Ayyub narrated it; what is preserved (mahfuz) is that it is the saying of Sa'id bin al-Musayyib and Sulayman bin Yasar.

Ibn al-Musayyib (may Allah have mercy on him) and Sulayman bin Yasar (may Allah have mercy on him) say that the 'aqilah are liable for a third of the blood money or more. Imam al-Shafi'i (may Allah have mercy on him) says that they are liable for the blood money whether it is small or large, because the Prophet (peace and blessings be upon him) made no distinction in it between small and large; and concerning that woman's miscarried child, he (peace and blessings be upon him) also pronounced the ruling of half of one tenth of the blood money upon the 'aqilah.

Imam al-Shafi'i (may Allah have mercy on him) says that some of them said that Yahya bin Sa'id (may Allah have mercy on him) said: The old practice is that the 'aqilah are liable for a third of the blood money or more. We said: The "old practice" may come from one who is followed and whose word is binding, and it may come from governors who are not followed and whose word is not binding. Shall we then abandon the certainty that the Prophet (peace and blessings be upon him) ruled half of one tenth of the blood money upon the 'aqilah because of a conjecture?
