أَخْبَرَنَا أَبُو سَعِيدِ بْنُ أَبِي عَمْرٍو، ثنا أَبُو الْعَبَّاسِ الْأَصَمُّ، ثنا بَحْرُ بْنُ نَصْرٍ، ثنا عَبْدُ اللهِ بْنُ وَهْبٍ، قَالَ: وَأَخْبَرَنِي ابْنُ أَبِي ذِئْبٍ، عَنْ سَعِيدِ بْنِ الْمُسَيِّبِ، وَسُلَيْمَانَ بْنِ يَسَارٍ، أَنَّهُمَا قَالَا: لَا تَحْمِلُ الْعَاقِلَةُ إِلَّا ثُلُثَ الدِّيَةِ فَصَاعِدًا، كَذَا قَالَا وَذَهَبَ الشَّافِعِيُّ إِلَى أَنَّهَا تَحْمِلُ كُلَّ مَا كَثُرَ وَقَلَّ؛ لِأَنَّ رَسُولَ اللهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ لَمَّا حَمَّلَهَا الْأَكْثَرَ دَلَّ عَلَى تَحْمِيلِهَا الْأَيْسَرَ، قَالَ: وَقَضَى رَسُولُ اللهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ فِي الْجَنِينِ بِغُرَّةٍ، وَقَضَى بِهِ عَلَى الْعَاقِلَةِ، وَذَلِكَ نِصْفُ عُشْرِ الدِّيَةِ.
Ibn al-Musayyib (may Allah have mercy on him) and Sulayman bin Yasar (may Allah have mercy on him) say that the 'aqilah are liable for a third of the blood money or more. Imam al-Shafi'i (may Allah have mercy on him) says that they are liable for the blood money whether it is small or large, because the Prophet (peace and blessings be upon him) made no distinction in it between small and large; and concerning that woman's miscarried child, he (peace and blessings be upon him) also pronounced the ruling of half of one tenth of the blood money upon the 'aqilah.
