باب: تصديق المرأة فيما يمكن فيه انقضاء عدتها

أَخْبَرَنَا أَبُو نَصْرٍ عُمَرُ بْنُ عَبْدِ الْعَزِيزِ بْنِ عُمَرَ بْنِ قَتَادَةَ أنا أَبُو مَنْصُورٍ الْعَبَّاسُ بْنُ الْفَضْلِ النَّضْرَوِيُّ، نا أَحْمَدُ بْنُ نَجْدَةَ، نا سَعِيدُ بْنُ مَنْصُورٍ، ثنا فُضَيْلُ بْنُ عِيَاضٍ، عَنْ سُلَيْمَانَ، عَنْ مُسْلِمِ بْنِ صُبَيْحٍ، عَنْ مَسْرُوقٍ، عَنْ أُبَيِّ بْنِ كَعْبٍ قَالَ: " إِنَّ مِنَ الْأَمَانَةِ أَنَّ الْمَرْأَةَ اؤْتُمِنَتْ عَلَى فَرْجِهَا " وَرَوَى الشَّافِعِيُّ عَنْ سُفْيَانَ عَنْ عَمْرِو بْنِ دِينَارٍ عَنْ عُبَيْدِ بْنِ عُمَيْرٍ قَالَ: اؤْتُمِنَتِ الْمَرْأَةُ عَلَى فَرْجِهَا.
It is narrated from Ubayy bin Ka'b (may Allah be pleased with him): It is part of the trust (amanah) that a woman is the trustee of her private parts. And Imam al-Shafi'i (may Allah have mercy on him) narrated from Sufyan, from Amr bin Dinar, that Ubayd bin Umayr said: The woman has been entrusted with her private parts.
وَأَخْبَرَنَا أَبُو نَصْرِ بْنُ قَتَادَةَ، أنبأ أَبُو مَنْصُورٍ النَّضْرَوِيُّ، ثنا أَحْمَدُ بْنُ نَجْدَةَ، ثنا سَعِيدُ بْنُ مَنْصُورٍ، نا أَبُو شِهَابٍ، عَنْ إِسْمَاعِيلَ بْنِ أَبِي خَالِدٍ، عَنِ الشَّعْبِيِّ قَالَ: جَاءَ رَجُلٌ إِلَى عَلِيِّ بْنِ أَبِي طَالِبٍ رَضِيَ اللهُ عَنْهُ فَقَالَ: إِنِّي طَلَّقْتُ امْرَأَتِي فَجَاءَتْ بَعْدَ شَهْرَيْنِ فَقَالَتْ: قَدِ انْقَضَتْ عِدَّتِي وَعِنْدَ عَلِيٍّ رَضِيَ اللهُ عَنْهُ شُرَيْحٌ فَقَالَ: قُلْ فِيهَا، قَالَ: وَأَنْتَ شَاهِدٌ يَا أَمِيرَ الْمُؤْمِنِينَ قَالَ: نَعَمْ قَالَ: " إِنْ جَاءَتْ بِبِطَانَةٍ مِنْ أَهْلِهَا مِنَ الْعُدُولِ يَشْهَدُونَ أَنَّهَا حَاضَتْ ثَلَاثَ حِيَضٍ وَإِلَّا فَهِيَ كَاذِبَةٌ "، فَقَالَ عَلِيٌّ رَضِيَ اللهُ عَنْهُ: " قَالُونُ، بِالرُّومِيَّةِ أَيْ أَصَبْتَ ".
It is narrated from al-Sha'bi that a man came to Ali bin Abi Talib (may Allah be pleased with him) and said: I divorced my wife, and she came after two months and said: My waiting period has ended. Qadi Shurayh was present with Ali (may Allah be pleased with him), and he (Ali) said: Give a judgement concerning her. He (Shurayh) said: While you are present, O Commander of the Faithful? He said: Yes. He (Shurayh) said: If she brings close members of her family who are upright, testifying that she has menstruated three times, (her claim stands); otherwise she is lying. Ali (may Allah be pleased with him) said: "Qalun", which in the Roman language means: You have judged correctly.
وَأَخْبَرَنَا أَبُو عَبْدِ اللهِ الْحَافِظُ قِرَاءَةً أنا أَبُو الْوَلِيدِ، نا عَبْدُ اللهِ بْنُ مُحَمَّدٍ، نا ⦗٦٨٨⦘ حُمَيْدُ بْنُ مَسْعَدَةَ، نا خَالِدُ بْنُ الْحَارِثِ، عَنْ سَعِيدٍ، عَنْ قَتَادَةَ، عَنْ عَزْرَةَ، عَنِ الْحَسَنِ الْعُرَنِيِّ، أَنَّ شُرَيْحًا رُفِعَتْ إِلَيْهِ امْرَأَةٌ طَلَّقَهَا زَوْجُهَا فَحَاضَتْ فِي خَمْسٍ وَثَلَاثِينَ لَيْلَةً ثَلَاثَ حِيَضٍ فَذَكَرَ نَحْوَ حَدِيثِ الشَّعْبِيِّ فَرَفَعَ ذَلِكَ شُرَيْحٌ إِلَى عَلِيِّ بْنِ أَبِي طَالِبٍ رَضِيَ اللهُ عَنْهُ فَقَالَ: " سَلُوا عَنْهَا جَارَاتِهَا فَإِنْ كَانَ حَيْضُهَا كَذَا انْقَضَتْ عِدَّتُهَا " وَذَكَرَ الْحَدِيثَ.
It is narrated from al-Hasan al-Urani (may Allah have mercy on him) that a woman was brought to Shurayh (may Allah have mercy on him) whose husband had divorced her; she menstruated for the third time on the thirty-fifth night. He mentioned it in the same way as the hadith of al-Sha'bi (may Allah have mercy on him). Shurayh (may Allah have mercy on him) referred this (matter) to Sayyiduna Ali (may Allah be pleased with him), who said: Ask her neighbours about her; if her menstruation is like this, then her waiting period ('iddah) has ended.
أَخْبَرَنَا أَبُو بَكْرِ بْنُ الْحَارِثِ، أنا عَلِيُّ بْنُ عُمَرَ الْحَافِظُ، نا إِبْرَاهِيمُ بْنُ حَمَّادٍ، نا مُحَمَّدُ بْنُ عَبْدِ اللهِ الْمُخَرِّمِيُّ، نا يَحْيَى بْنُ آدَمَ، نا حَفْصٌ، عَنْ أَشْعَثَ، عَنْ عَطَاءٍ قَالَ: " أَكْثَرُ الْحَيْضِ خَمْسَةَ عَشَرَ ".
It is narrated from Ata (may Allah have mercy on him) that the maximum (number of days of) menstruation is fifteen days.
وَأَخْبَرَنَا أَبُو بَكْرِ بْنُ الْحَارِثِ، أنا عَلِيُّ بْنُ عُمَرَ، نا الْحُسَيْنُ بْنُ إِسْمَاعِيلَ، نا أَبُو إِبْرَاهِيمَ الزَّاهِدِيُّ، نا النُّفَيْلِيُّ قَالَ: قَرَأْتُ عَلَى مَعْقِلِ بْنِ عُبَيْدِ اللهِ عَنْ عَطَاءِ بْنِ أَبِي رَبَاحٍ قَالَ: " أَدْنَى وَقْتِ الْحَيْضِ يَوْمٌ " قَالَ أَبُو إِبْرَاهِيمَ إِلَى هَذَيْنِ الْحَدِيثَيْنِ كَانَ يَذْهَبُ الْإِمَامُ الْوَرِعُ الْإِمَامُ أَحْمَدُ بْنُ حَنْبَلٍ رَحِمَهُ اللهُ تَعَالَى.
It is narrated from Ata bin Abi Rabah (may Allah have mercy on him) that the minimum duration of menstruation is one day. Abu Ibrahim (may Allah have mercy on him) said: The Imam of piety, Ahmad bin Hanbal (may Allah have mercy on him), held to these two narrations.
