أَخْبَرَنَا أَبُو بَكْرِ بْنُ الْحَارِثِ الْفَقِيهُ، أنا عَلِيُّ بْنُ عُمَرَ الْحَافِظُ، نا أَبُو مُحَمَّدِ بْنُ صَاعِدٍ، نا سَعْدُ بْنُ عَبْدِ اللهِ بْنِ عَبْدِ الْحَكَمِ، نا قُدَامَةُ بْنُ مُحَمَّدٍ، نا مَخْرَمَةُ بْنُ ⦗٦٧٦⦘ بُكَيْرٍ، عَنْ أَبِيهِ قَالَ: سَمِعْتُ مُحَمَّدَ بْنَ مُسْلِمِ بْنِ شِهَابٍ، يَزْعُمُ أَنَّ قَبِيصَةَ بْنَ ذُؤَيْبٍ، كَانَ يُحَدِّثُ عَنْ عُمَرَ بْنِ الْخَطَّابِ رَضِيَ اللهُ عَنْهُ أَنَّهُ " قَضَى فِي رَجُلٍ أَنْكَرَ وَلَدَ امْرَأَتِهِ وَهُوَ فِي بَطْنِهَا ثُمَّ اعْتَرَفَ بِهِ وَهُوَ فِي بَطْنِهَا حَتَّى إِذَا وُلِدَ أَنْكَرَهُ فَأَمَرَ بِهِ عُمَرُ بْنُ الْخَطَّابِ رَضِيَ اللهُ عَنْهُ فَجُلِدَ ثَمَانِينَ جَلْدَةً لِفِرْيَتِهِ عَلَيْهَا ثُمَّ أَلْحَقَ بِهِ وَلَدَهَا ".
Qabisah bin Dhu'ayb narrates from Sayyiduna Umar bin al-Khattab (may Allah be pleased with him) that he gave a ruling concerning a man who denied his wife's pregnancy, then acknowledged it, and when the child was born he denied it (again). Sayyiduna Umar (may Allah be pleased with him) had him given the prescribed punishment for slander, eighty lashes, and then attributed the child to the husband as well.
وَأَخْبَرَنَا أَبُو الْحُسَيْنِ بْنُ بِشْرَانَ الْعَدْلُ، بِبَغْدَادَ أنا إِسْمَاعِيلُ بْنُ مُحَمَّدٍ الصَّفَّارُ، نا سَعْدَانُ بْنُ نَصْرٍ، نا أَبُو مُعَاوِيَةَ، عَنْ مُجَالِدِ بْنِ سَعِيدٍ، عَنِ الشَّعْبِيِّ، عَنْ شُرَيْحٍ، عَنْ عُمَرَ رَضِيَ اللهُ عَنْهُ قَالَ: " إِذَا أَقَرَّ الرَّجُلُ بِوَلَدِهِ طَرْفَةَ عَيْنٍ فَلَيْسَ لَهُ أَنْ يَنْفِيَهُ " وَاللهُ أَعْلَمُ.
Qadi Shurayh narrates from Sayyiduna Umar (may Allah be pleased with him) that when a man acknowledges his child even for the blink of an eye, it is not proper for him to deny him after that.
