أَخْبَرَنَا عَبْدُ اللهِ بْنُ مُحَمَّدِ بْنِ الْحَسَنِ الْمِهْرَجَانِيُّ، أنا مُحَمَّدُ بْنُ جَعْفَرٍ الْمُزَكِّي، نا مُحَمَّدُ بْنُ إِبْرَاهِيمَ الْبُوشَنْجِيُّ، نا ابْنُ بُكَيْرٍ، نا مَالِكٌ، عَنْ نَافِعٍ، أَنَّ رُبَيِّعَ بِنْتَ مُعَوِّذٍ جَاءَتْ هِيَ وَعَمُّهَا إِلَى عَبْدِ اللهِ بْنِ عُمَرَ وَأَخْبَرَتْهُ أَنَّهَا اخْتَلَعَتْ مِنْ زَوْجِهَا فِي زَمَنِ عُثْمَانَ بْنِ عَفَّانَ رَضِيَ اللهُ عَنْهُ فَبَلَغَ ذَلِكَ عُثْمَانَ بْنَ عَفَّانَ فَلَمْ يُنْكِرْهُ فَقَالَ عَبْدُ اللهِ بْنُ عُمَرَ رَضِيَ اللهُ عَنْهُمَا: " عِدَّتُهَا عِدَّةُ الْمُطَلَّقَةِ ".
Nafi' (may Allah have mercy on him) said that Rubayyi' bint Mu'awwidh (may Allah be pleased with her) and her paternal uncle came to Abdullah bin Umar (may Allah be pleased with them both), and she told him that she had taken khul' from her husband in the time of Uthman (may Allah be pleased with him). When Uthman bin Affan (may Allah be pleased with him) learned of it, he did not object. Abdullah bin Umar (may Allah be pleased with them both) said: Her waiting period (iddah) is the waiting period of a divorced woman.
وَأَخْبَرَنَا أَبُو الْحُسَيْنِ بْنُ بِشْرَانَ، أنا إِسْمَاعِيلُ بْنُ مُحَمَّدٍ الصَّفَّارُ، نا ⦗٥١٧⦘ سَعْدَانُ بْنُ نَصْرٍ، نا مَعْمَرُ بْنُ سُلَيْمَانَ، عَنِ الْحَجَّاجِ، عَنِ ابْنِ شِهَابٍ، عَنْ عُرْوَةَ بْنِ الزُّبَيْرِ، أَنَّ رَجُلًا خَلَعَ امْرَأَتَهُ فِي وِلَايَةِ عُثْمَانَ رَضِيَ اللهُ عَنْهُ عِنْدَ غَيْرِ سُلْطَانٍ فَأَجَازَهُ عُثْمَانُ رَضِيَ اللهُ عَنْهُ.
Urwah bin al-Zubayr (may Allah have mercy on him) said that a man took khul' from his wife during the caliphate of Uthman (may Allah be pleased with him) without going before a ruler, and Uthman (may Allah be pleased with him) declared it valid.
