The marriage of a slave without his owner's permission

أَخْبَرَنَا أَبُو الْحَسَنِ عَلِيُّ بْنُ أَحْمَدَ بْنِ عَبْدَانَ، أنبأ أَحْمَدُ بْنُ عُبَيْدٍ الصَّفَّارُ، ثنا هِشَامُ بْنُ عَلِيٍّ، ثنا ابْنُ رَجَاءٍ، ثنا الْحَسَنُ يَعْنِي ابْنَ صَالِحِ بْنِ حَيٍّ، عَنْ عَبْدِ اللهِ بْنِ مُحَمَّدِ بْنِ عَقِيلٍ قَالَ: سَمِعْتُ جَابِرَ بْنَ عَبْدِ اللهِ رَضِيَ اللهُ عَنْهُمَا يَقُولُ: قَالَ رَسُولُ اللهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ: " أَيُّمَا مَمْلُوكٍ تَزَوَّجَ بِغَيْرِ إِذْنِ سَيِّدِهِ فَهُوَ عَاهِرٌ ".
Jabir bin Abdullah (may Allah be pleased with them both) says that he heard the Prophet (peace and blessings be upon him) say: "Any slave who marries without the permission of his master is a fornicator."
وَأَخْبَرَنَا أَبُو الْحُسَيْنِ بْنُ بِشْرَانَ، أنبأ أَبُو الْحَسَنِ عَلِيُّ بْنُ مُحَمَّدٍ الْمِصْرِيُّ، ثنا مَالِكُ بْنُ يَحْيَى، ثنا يَزِيدُ بْنُ هَارُونَ، أنبأ هَمَّامُ بْنُ يَحْيَى، عَنِ ابْنِ عَبْدِ الْوَاحِدِ الْمَكِّيِّ، عَنْ عَبْدِ اللهِ بْنِ مُحَمَّدِ بْنِ عَقِيلٍ، عَنْ جَابِرِ بْنِ عَبْدِ اللهِ قَالَ: قَالَ رَسُولُ اللهِ صلَّى الله عَلَيْهِ وَسَلَّمَ: " أَيُّمَا عَبْدٍ تَزَوَّجَ بِغَيْرِ إِذْنِ مَوَالِيهِ فَهُوَ عَاهِرٌ "، ⦗٢٠٦⦘ هُوَ الْقَاسِمُ بْنُ عَبْدِ الْوَاحِدِ.
Likewise (through another chain).
أَخْبَرَنَا أَبُو عَلِيٍّ الرُّوذْبَارِيُّ، أنبأ أَبُو بَكْرِ بْنُ دَاسَةَ، ثنا أَبُو دَاوُدَ، ثنا عُقْبَةُ بْنُ مُكْرَمٍ، ثنا أَبُو قُتَيْبَةَ، عَنْ عَبْدِ اللهِ بْنِ عُمَرَ، عَنْ نَافِعٍ، عَنِ ابْنِ عُمَرَ رَضِيَ اللهُ عَنْهُمَا عَنِ النَّبِيِّ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ قَالَ: " إِذَا نَكَحَ الْعَبْدُ بِغَيْرِ إِذْنِ مَوْلَاهُ فَنِكَاحُهُ بَاطِلٌ ".
Ibn Umar (may Allah be pleased with them both) narrates from the Prophet (peace and blessings be upon him) that he (peace and blessings be upon him) said: "When a slave marries without the permission of his master, his marriage is void."
أَخْبَرَنَا عَلِيُّ بْنُ مُحَمَّدِ بْنِ عَبْدِ اللهِ بْنِ بِشْرَانَ، أنبأ إِسْمَاعِيلُ بْنُ مُحَمَّدٍ الصَّفَّارُ، ثنا الْحَسَنُ بْنُ عَلِيِّ بْنِ عَفَّانَ، ثنا عَبْدُ اللهِ بْنُ نُمَيْرٍ، عَنْ عَبْدِ اللهِ بْنِ عُمَرَ، عَنْ نَافِعٍ، عَنِ ابْنِ عُمَرَ، أَنَّهُ كَانَ يَرَى " أَنَّ نِكَاحَ الْعَبْدِ بِغَيْرِ إِذْنِ سَيِّدِهِ زِنًا وَيُعَاقَبُ مَنْ زَوَّجَهُ ".
Sayyiduna Ibn Umar (may Allah be pleased with them both) considered the marriage of a slave without his master's permission to be fornication, and he would say: Whoever arranges such a marriage is to be punished.
وَبِإِسْنَادِهِ عَنِ ابْنِ عُمَرَ، أَنَّهُ كَانَ يَقُولُ: " إِذَا تَزَوَّجَ بِغَيْرِ إِذْنِ مَوَالِيهِ فَالطَّلَاقُ بِيَدِ الْعَبْدِ "، وَرُوِّينَا عَنْ عُمَرَ بْنِ الْخَطَّابِ رَضِيَ اللهُ عَنْهُ بِمَعْنَاهُ، وَعَنِ ابْنِ عُمَرَ أَنَّهُ قَالَ فِي مَمْلُوكٍ تَزَوَّجَ حُرَّةً بِغَيْرِ إِذْنِ مَوَالِيهِ قَالَ: هِيَ أَبَاحَتْ فَرْجَهَا.
Sayyiduna Abdullah bin Umar (may Allah be pleased with them both) used to say: When a slave marries without the permission of his master, the divorce is in the slave's hands. It is narrated from Sayyiduna Abdullah bin Umar (may Allah be pleased with them both) concerning a slave who married a free woman without his master's permission: She is a woman who has made her private part lawful.
