أَخْبَرَنَا أَبُو سَعِيدِ بْنُ أَبِي عَمْرٍو، ثنا أَبُو الْعَبَّاسِ الْأَصَمُّ، أنا الرَّبِيعُ بْنُ سُلَيْمَانَ قَالَ: قَالَ الشَّافِعِيُّ: أنا سَعِيدُ بْنُ سَالِمٍ، عَنِ ابْنِ جُرَيْجٍ، عَنْ مُوسَى بْنِ عُقْبَةَ، عَنْ نَافِعٍ مَوْلَى ابْنِ عُمَرَ أَنَّهُ قَالَ: " كَانَتِ ابْنَةُ حَفْصِ بْنِ الْمُغِيرَةِ عِنْدَ عَبْدِ اللهِ بْنِ أَبِي رَبِيعَةَ فَطَلَّقَهَا تَطْلِيقَةً، ثُمَّ إِنَّ عُمَرَ بْنَ الْخَطَّابِ رَضِيَ اللهُ عَنْهُ تَزَوَّجَهَا، فَحُدِّثَ أَنَّهَا عَاقِرٌ لَا تَلِدُ، فَطَلَّقَهَا قَبْلَ أَنْ يُجَامِعَهَا، فَمَكَثَتْ حَيَاةَ عُمَرَ وَبَعْضَ خِلَافَةِ عُثْمَانَ رَضِيَ اللهُ عَنْهُمَا، ثُمَّ تَزَوَّجَهَا عَبْدُ اللهِ بْنُ أَبِي رَبِيعَةَ وَهُوَ مَرِيضٌ لِتُشْرِكَ نِسَاءَهُ فِي الْمِيرَاثِ، وَكَانَتْ بَيْنَهُ وَبَيْنَهَا قَرَابَةٌ ".
Nafi' (may Allah have mercy on him), the freed slave of Sayyiduna Abdullah bin Umar (may Allah be pleased with them both), said: The daughter of Hafs bin al-Mughirah was married to Abdullah bin Abi Rabi'ah. He divorced her once, then Sayyiduna Umar bin al-Khattab (may Allah be pleased with him) married her. He was told that she was barren and could not bear children, so he divorced her before consummating the marriage. She remained (unmarried) throughout the life of Sayyiduna Umar (may Allah be pleased with him) and part of the caliphate of Sayyiduna Uthman (may Allah be pleased with him). Then Abdullah bin Abi Rabi'ah married her while he was ill, so that she would share in the inheritance with his wives; and there was kinship between him and her.
وَبِإِسْنَادِهِ قَالَ: قَالَ الشَّافِعِيُّ: أنا سَعِيدٌ، عَنِ ابْنِ جُرَيْجٍ، عَنْ عَمْرِو بْنِ دِينَارٍ، أَنَّهُ سَمِعَ عِكْرِمَةَ بْنَ خَالِدٍ يَقُولُ: " أَرَادَ عَبْدُ الرَّحْمَنِ بْنُ أُمِّ الْحَكَمِ فِي شَكْوَاهُ أَنْ يُخْرِجَ امْرَأَتَهُ مِنْ مِيرَاثِهَا، فَأَبَتْ، فَنَكَحَ عَلَيْهَا ثَلَاثَ نِسْوَةٍ، وَأَصْدَقَهُنَّ أَلْفَ دِينَارٍ كُلَّ امْرَأَةٍ مِنْهُنَّ، فَأَجَازَ ذَلِكَ عَبْدُ الْمَلِكِ بْنُ مَرْوَانَ، وَشَرَّكَ بَيْنَهُنَّ فِي الثُّمُنِ " قَالَ الشَّافِعِيُّ: أَرَى ذَلِكَ صَدَاقَ مِثْلِهِنَّ قَالَ الشَّافِعِيُّ: وَبَلَغَنِي أَنَّ مُعَاذَ بْنَ جَبَلٍ قَالَ فِي مَرَضِهِ الَّذِي مَاتَ فِيهِ: زَوِّجُونِي؛ لَا أَلْقَى اللهَ وَأَنَا أَعْزَبُ.
Amr bin Dinar heard Ikrimah bin Khalid say: Abd al-Rahman bin Umm al-Hakam, during his illness, intended to exclude his wife from her inheritance, but she refused. So Abd al-Rahman married three more women in addition to her and fixed the dower of each of them at one thousand dinars. Abd al-Malik bin Marwan permitted that and made her share the eighth with them. Imam al-Shafi'i (may Allah have mercy on him) said: This means a dower like theirs. And Imam al-Shafi'i (may Allah have mercy on him) said: It has reached me that Sayyiduna Mu'adh bin Jabal (may Allah be pleased with him) said during the illness in which he died: Marry me off; I do not wish to meet Allah while I am unmarried.
