Those who placed the surplus after the fixed shares in the public treasury when no residuary heir or patron is left, and did not return any of it to the sharers

أَخْبَرَنَا أَبُو الْحَسَنِ عَلِيُّ بْنُ أَحْمَدَ بْنِ عَبْدَانَ، أنا أَحْمَدُ بْنُ عُبَيْدٍ الصَّفَّارُ، ثنا مُحَمَّدُ بْنُ الْفُضَيْلِ بْنِ جَابِرٍ، ثنا عَبْدُ الْجَبَّارِ بْنُ عَاصِمٍ، ثنا إِسْمَاعِيلُ بْنُ عَيَّاشٍ، عَنْ شُرَحْبِيلَ بْنِ مُسْلِمٍ، عَنْ أَبِي أُمَامَةَ الْبَاهِلِيِّ قَالَ: سَمِعْتُ رَسُولَ اللهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ يَقُولُ فِي خُطْبَتِهِ فِي حِجَّةِ الْوَدَاعِ: " إِنَّ اللهَ عَزَّ وَجَلَّ قَدْ أَعْطَى كُلَّ ذِي حَقٍّ حَقَّهُ، لَا وَصِيَّةَ لِوَارِثٍ ".
Sayyiduna Abu Umamah al-Bahili (may Allah be pleased with him) said: I heard the Messenger of Allah (peace and blessings be upon him) during the Farewell Pilgrimage; he (peace and blessings be upon him) said: "Allah Almighty has given everyone who has a right his right; so now there is no bequest for an heir."
أَخْبَرَنَا أَبُو عَبْدِ اللهِ الْحَافِظُ، ثنا أَبُو الْعَبَّاسِ مُحَمَّدُ بْنُ يَعْقُوبَ، ثنا يَحْيَى بْنُ أَبِي طَالِبٍ، أنا يَزِيدُ بْنُ هَارُونَ، أنا مُحَمَّدُ بْنُ سَالِمٍ، عَنِ الشَّعْبِيِّ، عَنْ خَارِجَةَ بْنِ زَيْدٍ قَالَ: " رَأَيْتُ أَبِي يَجْعَلُ فُضُولَ الْمَالِ فِي بَيْتِ الْمَالِ، وَلَا يَرُدُّ عَلَى وَارِثٍ شَيْئًا ".
Kharijah bin Zayd (may Allah have mercy on him) said: I saw my father putting the surplus property into the public treasury (bayt al-mal), and he would not give anything to an heir.
قَالَ: وَأَخْبَرَنِي مُحَمَّدُ بْنُ سَالِمٍ، عَنِ الشَّعْبِيِّ قَالَ: كَانَ عَلِيٌّ رَضِيَ اللهُ عَنْهُ " يَرُدُّ عَلَى كُلِّ وَارِثٍ الْفَضْلَ بِحِصَّةِ مَا وَرَّثَ غَيْرَ الْمَرْأَةِ وَالزَّوْجِ ".
Al-Sha'bi (may Allah have mercy on him) said that Sayyiduna Ali (may Allah be pleased with him) used to return the surplus to every heir in proportion to his share, except the wife and the husband.
