باب: من جعل ما فضل عن أهل الفرائض ولم يخلف عصبة ولا مولى في بيت المال ولم يرد على ذي فرض شيئا
Chapter: Those who placed the surplus after the fixed shares in the public treasury when no residuary heir or patron is left, and did not return any of it to the sharers

قَالَ: وَأَخْبَرَنِي مُحَمَّدُ بْنُ سَالِمٍ، عَنِ الشَّعْبِيِّ قَالَ: كَانَ عَلِيٌّ رَضِيَ اللهُ عَنْهُ " يَرُدُّ عَلَى كُلِّ وَارِثٍ الْفَضْلَ بِحِصَّةِ مَا وَرَّثَ غَيْرَ الْمَرْأَةِ وَالزَّوْجِ ".
Al-Sha'bi (may Allah have mercy on him) said that Sayyiduna Ali (may Allah be pleased with him) used to return the surplus to every heir in proportion to his share, except the wife and the husband.
