Bayhaqi 8703 — Delaying Hajj

Imam al-Shafi'i (may Allah have mercy on him) said: Hajj was made obligatory upon the Messenger of Allah (peace and blessings be upon him) after the Hijrah. He (peace and blessings be upon him) conquered Makkah in the month of Ramadan and left it in Shawwal, and appointed Attab bin Asid (may Allah be pleased with him) as his deputy there, who organised the Hajj for the Muslims by the order of the Messenger of Allah (peace and blessings be upon him), while he (peace and blessings be upon him) was in Madinah, as were his pure wives (may Allah be pleased with them) and most of the Companions (may Allah be pleased with them), even though he (peace and blessings be upon him) was able to perform Hajj. Then he (peace and blessings be upon him) returned from the expedition of Tabuk and sent Abu Bakr (may Allah be pleased with him), who led the people in Hajj in the ninth year, while the Messenger of Allah (peace and blessings be upon him) remained in Madinah, able to perform Hajj; yet neither he (peace and blessings be upon him), nor his pure wives (may Allah be pleased with them), nor any of his (peace and blessings be upon him) Companions (may Allah be pleased with them) performed Hajj, until he (peace and blessings be upon him) performed Hajj in the tenth year of the Hijrah. From this we infer that the obligation of Hajj is once in a lifetime, from puberty until before death.
The Shaykh said: What Imam al-Shafi'i (may Allah have mercy on him) mentioned is found in the books of reports and histories. As for what he mentioned, that the obligation of Hajj was revealed after the Hijrah, he is correct; our companions have inferred from the narration of Ka'b bin Ujrah (may Allah be pleased with him) that its obligation came at the time of (the Treaty of) Hudaybiyah.
