Bayhaqi 648 — Not performing ablution (wudu) after touching

The muhaddith Raja' bin Murajja (may Allah have mercy on him) said: Ahmad bin Hanbal, Ali bin al-Madini, Yahya bin Ma'in (may Allah have mercy on them) and I gathered in Masjid al-Khayf, and a debate took place there about touching the private part (whether it requires ablution or not). Yahya bin Ma'in (may Allah have mercy on him) said: Ablution is required because of it. Ali bin al-Madini (may Allah have mercy on him) followed the view of the people of Kufah. The evidence of Ibn Ma'in (may Allah have mercy on him) was the hadith of Sayyidah Busrah bint Safwan (may Allah be pleased with her), and the evidence of Ali bin al-Madini (may Allah have mercy on him) was the narration of Qays bin Talq. He said to Yahya bin Ma'in (may Allah have mercy on him): How can you accept the chain of Busrah (may Allah be pleased with her) when Marwan bin al-Hakam sent a guard, who brought her answer back to Marwan? Yahya bin Ma'in (may Allah have mercy on him) said: Then Urwah was not satisfied with that until he came to Sayyidah Busrah (may Allah be pleased with her) and asked her, and she told him the hadith face to face. Then Yahya bin Ma'in (may Allah have mercy on him) said: People have spoken a great deal against Qays bin Talq, and his hadith is not accepted as evidence. Ahmad bin Hanbal (may Allah have mercy on him) said: Both matters are as you two have said.
Yahya said: It is narrated through Malik, from Nafi', from Sayyiduna Ibn Umar (may Allah be pleased with them both), that ablution is to be performed because of touching the private part. Ali bin al-Madini (may Allah have mercy on him) said that Ibn Mas'ud (may Allah be pleased with him) used to say: "There is no ablution because of it; it is only a part of your body." Yahya said: From whom is this narrated? He said: Through Sufyan, from Abu Qays, from Huzayl, from Sayyiduna Abdullah (may Allah be pleased with him); and when Ibn Mas'ud and Ibn Umar (may Allah be pleased with them) differ on a matter, Ibn Mas'ud (may Allah be pleased with him) is more entitled to be followed. Imam Ahmad bin Hanbal (may Allah have mercy on him) said to him: Yes, but the hadith of Abu Qays al-Awdi is not accepted as evidence. Ali bin al-Madini (may Allah have mercy on him) said: Abu Nu'aym narrated to me from Mis'ar, from Umayr bin Sa'id, from Sayyiduna Ammar (may Allah be pleased with him), that he said: "I do not care whether I touch it or my nose." Yahya said: Between Umayr bin Sa'id and Ammar bin Yasir there is a wide gap (i.e. the chain is broken).
