أَخْبَرَنَا أَبُو بَكْرٍ أَحْمَدُ بْنُ الْحَسَنِ الْقَاضِي ثنا أَبُو الْعَبَّاسِ مُحَمَّدُ بْنُ يَعْقُوبَ، أنبأ الرَّبِيعُ بْنُ سُلَيْمَانَ، أنبأ الشَّافِعِيُّ، أنبأ مَالِكٌ، عَنْ عَبْدِ اللهِ بْنِ أَبِي بَكْرٍ، عَنْ عَبْدِ الْمَلِكِ بْنِ أَبِي بَكْرِ بْنِ عَبْدِ الرَّحْمَنِ بْنِ الْحَارِثِ بْنِ هِشَامٍ، عَنْ أَبِيهِ، أَنَّهُ أَخْبَرَهُ أَنَّ الْعَاصَ بْنَ هِشَامٍ هَلَكَ وَتَرَكَ بَنِينَ لَهُ ثَلَاثَةً، اثْنَانِ لِأُمٍّ، وَرَجُلٌ لِعِلَّةٍ، فَهَلَكَ أَحَدُ اللَّذَيْنِ لِأُمٍّ، فَتَرَكَ مَالًا وَمَوَالِيَ، فَوَرِثَهُ أَخُوهُ الَّذِي لِأُمِّهِ وَأَبِيهِ مَالَهُ وَوَلَاءَ مَوَالِيهِ، ثُمَّ هَلَكَ الَّذِي وَرِثَ الْمَالَ وَوَلَاءَ الْمَوَالِي، وَتَرَكَ ابْنَهُ وَأَخَاهُ لِأَبِيهِ، فَقَالَ ابْنُهُ: قَدْ أَحْرَزْتُ مَا كَانَ أَبِي أَحْرَزَ مِنَ الْمَالِ وَوَلَاءَ الْمَوَالِي، وَقَالَ أَخُوهُ: لَيْسَ كَذَلِكَ، إِنَّمَا أَحْرَزْتَ الْمَالَ، فَأَمَّا وَلَاءُ الْمَوَالِي فَلَا، أَرَأَيْتَ لَوْ هَلَكَ أَخِي الْيَوْمَ، أَلَسْتُ أَرِثُهُ أَنَا؟ فَاخْتَصَمَا إِلَى عُثْمَانَ بْنِ عَفَّانَ رَضِيَ اللهُ عَنْهُ، فَقَضَى لِأَخِيهِ بِوَلَاءِ الْمَوَالِي..
Abd al-Malik bin Abi Bakr bin Abd al-Rahman bin al-Harith (may Allah have mercy on him) narrates from his father that al-As bin Hisham died and left three sons, two from one mother and the third from another mother. Then one of those two died, leaving wealth and freed slaves, and his full brother inherited the wealth and the wala' of the slaves. Then the one who had inherited the wealth and the wala' of the slaves also died. He left a son and a brother. His son said: I will keep what my father had secured. His brother said: Not so; you secure only the wealth, but as for the wala' of the slaves: if my brother were to die, would I not be his heir? Then the dispute of the two was brought to Sayyiduna Uthman bin Affan (may Allah be pleased with him), and he ruled the wala' of the slaves in favour of the brother.
