Book of Freeing Slaves
باب: : من قال: لعبده: أنت حر على أن عليك مائة دينار، أو خدمة سنة، أو عمل كذا، فقبل العبد، أيعتق على ذلك؟
Chapter: One who says to his slave: You are free on condition that you owe a hundred dinars, a year of service or such work, and the slave accepts; is he freed on that basis
Bayhaqi 21426 — One who says to his slave: You are free on condition
قَالَ الشَّافِعِيُّ رَحِمَهُ اللهُ: لَزِمَهُ ذَلِكَ، وَكَانَ دَيْنًا عَلَيْهِ..
Imam al-Shafi'i (may Allah have mercy on him) said: "That became binding on him, and it will be a debt upon him."
أَخْبَرَنَا أَبُو عَبْدِ اللهِ الْحَافِظُ، أنبأ أَبُو أَحْمَدَ بَكْرُ بْنُ مُحَمَّدٍ الصَّيْرَفِيُّ بِمَرْوَ، ثنا أَحْمَدُ بْنُ مُحَمَّدِ بْنِ عِيسَى، ثنا أَبُو مَعْمَرٍ، ثنا عَبْدُ الْوَارِثِ بْنُ سَعِيدٍ، ثنا سَعِيدُ بْنُ جُمْهَانَ، حَدَّثَنِي سَفِينَةُ، قَالَ: قَالَتْ لِي أُمُّ سَلَمَةَ: أُعْتِقُكَ وَأَشْتَرِطُ عَلَيْكَ أَنْ تَخْدُمَ رَسُولَ اللهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ مَا عِشْتَ، قَالَ: قُلْتُ: " لَوْ أَنَّكِ لَمْ تَشْتَرِطِي عَلَيَّ مَا فَارَقْتُ رَسُولَ اللهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ مَا عِشْتُ "، قَالَ: " فَأَعْتَقَتْنِي، وَاشْتَرَطَتْ عَلَيَّ أَنْ أَخْدُمَ رَسُولَ اللهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ مَا عِشْتُ " ⦗٤٩٢⦘ رَوَاهُ أَبُو دَاوُدَ فِي كِتَابِ السُّنَنِ، عَنْ مُسَدَّدٍ، عَنْ عَبْدِ الْوَارِثِ..
Safinah (may Allah be pleased with him) says that Umm Salamah (may Allah be pleased with her) said: I will free you, but I have one condition: that you serve the Messenger of Allah (peace and blessings be upon him) for as long as you live. I said: Even if you did not make this condition, I would not part from the Messenger of Allah (peace and blessings be upon him) for as long as I live. But she made the condition that I serve the Messenger of Allah (peace and blessings be upon him) until my death.
