أَخْبَرَنَا أَبُو عَبْدِ اللهِ الْحَافِظُ، أنبأ أَبُو الْوَلِيدِ الْفَقِيهُ، ثنا جَعْفَرُ بْنُ أَحْمَدَ، ثنا عَلِيُّ بْنُ حُجْرٍ، ثنا هُشَيْمٌ، عَنْ دَاوُدَ، عَنِ الشَّعْبِيِّ، قَالَ: كَتَبَ عَبْدُ الرَّحْمَنِ بْنُ أُذَيْنَةَ إِلَى شُرَيْحٍ فِي نَاسٍ مِنَ الْأَزْدِ ادَّعَوْا قِبَلَ نَاسٍ مِنْ بَنِي أَسَدٍ، قَالَ: وَإِذَا غَدَا هَؤُلَاءِ بِبَيِّنَةٍ رَاحَ أُولَئِكَ بِأَكْثَرَ مِنْهُمْ، قَالَ: فَكَتَبَ إِلَيْهِ: " لَسْتُ مِنَ التَّهَاتُرِ وَالتَّكَاثُرِ فِي شَيْءٍ، الدَّابَّةُ لِمَنْ هِيَ فِي أَيْدِيهِمْ إِذَا أَقَامُوا الْبَيِّنَةَ ".
Al-Sha'bi said that Abd al-Rahman bin Udhaynah wrote to Qadi Shurayh about some people of al-Azd who had brought a claim against some people of Banu Asad: whenever these came in the morning with witnesses, those came in the evening with more than them. So he (Shurayh) wrote back to him: I have nothing to do with witnesses cancelling one another out or outnumbering one another. The animal remains with those in whose possession it is, when they have produced witnesses.
