Bayhaqi 21208 — The burden of proof is on the claimant and the oath
أَخْبَرَنَا أَبُو عَبْدِ اللهِ الْحَافِظُ، وَأَبُو بَكْرٍ الْقَاضِي، وَأَبُو سَعِيدِ بْنُ أَبِي عَمْرٍو قَالُوا: ثنا أَبُو الْعَبَّاسِ مُحَمَّدُ بْنُ يَعْقُوبَ، ثنا يَحْيَى بْنُ أَبِي طَالِبٍ، أنبأ عَبْدُ الْوَهَّابِ بْنُ عَطَاءٍ، أنبأ سَعِيدٌ، عَنْ قَتَادَةَ، فِي قَوْلِهِ: {وَأَتَيْنَاهُ الْحِكْمَةَ وَفَصْلَ الْخِطَابِ} قَالَ: " الْبَيِّنَةُ عَلَى الْمُدَّعِي، وَالْيَمِينُ عَلَى الْمُدَّعَى عَلَيْهِ " وَرَوَيْنَا فِيمَا مَضَى عَنْ شُرَيْحٍ أَنَّهُ قَالَ فِي هَذِهِ الْآيَةِ: " الْأَيْمَانُ وَالشُّهُودُ ".
Qatadah (may Allah have mercy on him), concerning the saying of Allah, "And We gave him wisdom and decisive speech" [Surah Sad: 20], said: The proof is upon the claimant, and the oath is upon the defendant.
