باب: : الرجل من أهل الفقه يسأل عن الرجل من أهل الحديث فيقول: كفوا عن حديثه، لأنه يغلط أو يحدث بما لم يسمع، أو أنه لا يبصر الفتيا
Chapter: A man of fiqh is asked about a man of hadith and says: Avoid his hadith, for he errs, or narrates what he did not hear, or has no insight into fatwa
Bayhaqi 20910 — A man of fiqh is asked about a man of hadith and says
قَالَ الشَّافِعِيُّ رَحِمَهُ اللهُ: " لَيْسَ هَذَا بِعَدَاوَةٍ وَلَا غِيبَةٍ، إِذَا كَانَ يَقُولُهُ لِمَنْ يَخَافُ أَنْ يَتَّبِعَهُ فَيُخْطِئَ بِاتِّبَاعِهِ، وَهَذَا مِنْ مَعَانِي الشَّهَادَاتِ.
Imam al-Shafi'i (may Allah have mercy on him) said: "This is neither enmity nor backbiting, when he says it to someone about whom he fears that he will follow him and fall into error by following him; and this is among the meanings of testimonies."
أَخْبَرَنَا أَبُو عَمْرٍو مُحَمَّدُ بْنُ عَبْدِ اللهِ الْبِسْطَامِيُّ، أنبأ أَبُو بَكْرٍ الْإِسْمَاعِيلِيُّ، أَخْبَرَنِي أَبُو يَعْلَى، ثنا أَبُو الرَّبِيعِ، ثنا حَمَّادٌ، ثنا ثَابِتٌ ح قَالَ: وَأَخْبَرَنَا أَبُو بَكْرٍ الْإِسْمَاعِيلِيُّ، أنبأ أَبُو بَكْرٍ الْمَرْوَزِيُّ، ثنا خَلَفُ بْنُ هِشَامٍ، ثنا حَمَّادٌ، عَنْ ثَابِتٍ، عَنْ أَنَسٍ، مُرَّ عَلَى النَّبِيِّ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ بِجِنَازَةٍ فَأُثْنِيَ عَلَيْهَا خَيْرًا، فَقَالَ النَّبِيُّ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ: " وَجَبَتْ "، قَالَ: وَمُرَّ عَلَيْهِ بِجِنَازَةٍ أُخْرَى فَأُثْنِيَ عَلَيْهَا شَرًّا، فَقَالَ النَّبِيُّ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ: " وَجَبَتْ "، فَقِيلَ: يَا رَسُولَ اللهِ، قُلْتَ لِذَلِكَ: " وَجَبَتْ "، وَقُلْتَ لِهَذِهِ: " وَجَبَتْ "، فَقَالَ: " شَهَادَةُ الْقَوْمِ، الْمُؤْمِنُونَ شُهَدَاءُ اللهِ فِي الْأَرْضِ " رَوَاهُ مُسْلِمٌ فِي الصَّحِيحِ، عَنْ أَبِي الرَّبِيعِ، وَرَوَاهُ الْبُخَارِيُّ عَنْ سُلَيْمَانَ بْنِ حَرْبٍ، عَنْ حَمَّادِ بْنِ زَيْدٍ وَرَوَيْنَا فِيمَا مَضَى، عَنِ النَّبِيِّ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ أَنَّهُ قَالَ: " إِنَّمَا الدِّينُ النَّصِيحَةُ ".
Sayyiduna Anas (may Allah be pleased with him) said: A funeral was passed by the Prophet (peace and blessings be upon him), and it was praised with good, so the Prophet (peace and blessings be upon him) said: "It has become obligatory." Another funeral was passed by, and it was spoken of badly; he (peace and blessings be upon him) said: "It has become obligatory." Then he (peace and blessings be upon him) was asked: Did you (peace and blessings be upon him) say of both that it has become obligatory? He (peace and blessings be upon him) said: "The believers are Allah's witnesses on the earth."
