Bayhaqi 20700 — Reinforcing the oath by time, and swearing
قَالَ اللهُ جَلَّ ثَنَاؤُهُ: {تَحْبِسُونَهُمَا مِنْ بَعْدِ الصَّلَاةِ فَيُقْسِمَانِ بِاللهِ} [المائدة: 106] قَالَ الشَّافِعِيُّ رَحِمَهُ اللهُ: " وَقَالَ الْمُفَسِّرُونَ: صَلَاةُ الْعَصْرِ. قَالَ الشَّيْخُ:.
Allah, exalted be His praise, says: "Detain them both after the prayer, then let them both swear by Allah." [Surah al-Ma'idah: 106]
Imam al-Shafi'i (may Allah have mercy on him) said: "And the commentators have said: (It refers to) the Asr prayer."
The Shaykh (Imam al-Bayhaqi) (may Allah have mercy on him) said:
Imam al-Shafi'i (may Allah have mercy on him) said: "And the commentators have said: (It refers to) the Asr prayer."
The Shaykh (Imam al-Bayhaqi) (may Allah have mercy on him) said:
قَدْ رُوِّينَا عَنِ الشَّعْبِيِّ، عَنْ أَبِي مُوسَى الْأَشْعَرِيِّ، فِي قِصَّةِ الْوَصِيَّةِ قَالَ: " هَذَا أَمْرٌ لَمْ يَكُنْ بَعْدَ الَّذِي كَانَ فِي عَهْدِ رَسُولِ اللهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ، فَأَحْلَفَهُمَا بَعْدَ الْعَصْرِ مَا خَانَا ". أَخْبَرَنَاهُ أَبُو نَصْرِ بْنُ قَتَادَةَ، أنبأ أَبُو مَنْصُورٍ الْعَبَّاسُ بْنُ الْفَضْلِ، أنبأ أَحْمَدُ بْنُ نَجْدَةَ، ثنا سَعِيدُ بْنُ مَنْصُورٍ، ثنا هُشَيْمٌ، أنبأ زَكَرِيَّا، عَنِ الشَّعْبِيِّ، فَذَكَرَهُ.
Abu Musa al-Ash'ari (may Allah be pleased with him) said concerning the story of the will: This matter has not happened since the time of the Prophet (peace and blessings be upon him). Then he made the two of them swear after Asr that they had not acted treacherously.
