Abu Ghatafan bin Tarif al-Murri (may Allah have mercy on him) said: Zayd bin Thabit and Ibn Muti' (may Allah be pleased with them both) brought their dispute (over a house) to Marwan, and Marwan imposed an oath on Zayd bin Thabit (may Allah be pleased with him), that he should swear at the minbar. Zayd (may Allah be pleased with him) said: I will swear for him here where I am. Marwan said: No, by Allah, only at the place where rights are decided. So Zayd (may Allah be pleased with him) began swearing that his right was indeed true, and refused to swear at the minbar, and Marwan was amazed at that.
Imam Malik (may Allah have mercy on him) said: Zayd (may Allah be pleased with him) disliked the binding oath.
