أَخْبَرَنَاهُ أَبُو سَعْدٍ الْمَالِينِيُّ، أَنْبَأَ أَبُو أَحْمَدَ بْنُ عَدِيٍّ، قَالَ: سَمِعْتُ ابْنَ حَمَّادٍ، يَذْكُرُهُ عَنِ الْبُخَارِيِّ قَالَ الشَّيْخُ رَحِمَهُ اللهُ: حُصُولُ الْإَجْمَاعِ مِنْ فُقَهَاءِ الْأَمْصَارِ بَعْدَ التَّابِعِينَ عَلَى تَرْكِ الْقَوْلِ بِهِ دَلِيلٌ عَلَى أَنَّهُ إِنْ ثَبَتَ صَارَ مَنْسُوخًا بِمَا وَرَدَ مِنَ الْأَخْبَارِ فِي الْحُدُودِ.
Imam al-Bukhari (may Allah have mercy on him) said that there is doubt (nazar) about this hadith, and Hammad mentions it from al-Bukhari, that is, in the previous narration.
The Shaykh (may Allah have mercy on him) said: The consensus of the jurists of the various lands after the Tabi'in on abandoning this view is evidence that, if it is established, it was abrogated by the reports that came regarding the hudud.
