Sayyiduna Salamah bin al-Muhabbiq (may Allah be pleased with him) said: A Companion of the Messenger of Allah (peace and blessings be upon him) was often travelling and taking part in military expeditions. His wife sent her slave-girl with him to do all his tasks, but she did not give her to her husband (as his own). The journey grew long, and he had intercourse with the slave-girl. When he returned, the slave-girl told the woman. She became intensely jealous and angry, and she came to the Prophet (peace and blessings be upon him). He (peace and blessings be upon him) said: "If he forced her, she is free, and the husband owes another slave-girl like her; and if she was willing, she belongs to the husband, and he will pay her price." But he (peace and blessings be upon him) did not carry out a hadd.
Al-Bukhari said, according to what reached me from him: This hadith of Qabisah is more sound, meaning than the narration of those who narrated it from al-Hasan from Salamah. Al-Bukhari said: None of our companions holds this view. And al-Bukhari said in al-Tarikh: Qabisah bin Hurayth al-Ansari heard Salamah bin al-Muhabbiq; there is doubt (nazar) about his hadith.
