أَخْبَرَنَا أَبُو عَبْدِ اللهِ الْحَافِظُ، وَأَبُو بَكْرٍ أَحْمَدُ بْنُ الْحَسَنِ، وَأَبُو زَكَرِيَّا بْنُ أَبِي إِسْحَاقَ، قَالُوا: ثنا أَبُو الْعَبَّاسِ مُحَمَّدُ بْنُ يَعْقُوبَ، أنبأ الرَّبِيعُ بْنُ سُلَيْمَانَ، أنبأ الشَّافِعِيُّ، أنبأ سُفْيَانُ، عَنْ عَمْرِو بْنِ دِينَارٍ، وَابْنِ طَاوُسٍ، عَنْ طَاوُسٍ، أَنَّ عُمَرَ بْنَ الْخَطَّابِ، رَضِيَ اللهُ عَنْهُ، قَالَ: أُذَكِّرُ اللهَ امْرَأً سَمِعَ مِنَ النَّبِيِّ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ فِي الْجَنِينِ شَيْئًا فَقَامَ حَمَلُ بْنُ مَالِكِ بْنِ النَّابِغَةِ، فَقَالَ: كُنْتُ بَيْنَ جَارِيَتَيْنِ لِي، يَعْنِي ضَرَّتَيْنِ، فَضَرَبَتْ إِحْدَاهُمَا الْأُخْرَى بِمِسْطَحٍ فَأَلْقَتْ جَنِينًا مَيِّتًا، فَقَضَى فِيهِ رَسُولُ اللهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ بِغُرَّةٍ فَقَالَ عُمَرُ رَضِيَ اللهُ عَنْهُ: لَوْ لَمْ نَسْمَعْ هَذَا لَقَضَيْنَا فِيهِ بِغَيْرِ هَذَا، وَقَالَ فِي مَوْضِعٍ آخَرَ: عَنْ عَمْرٍو وَحْدَهُ، وَقَالَ فِي الْحَدِيثِ، فَقَالَ عُمَرُ رَضِيَ اللهُ عَنْهُ: إِنْ كِدْنَا أَنْ نَقْضِيَ فِي مِثْلِ هَذَا بِرَأْينَا وَقَدْ رُوِّينَا مَوْصُولًا عَنِ ابْنِ جُرَيْجٍ، عَنْ عَمْرِو بْنِ دِينَارٍ.
It is narrated from Sayyiduna Umar (may Allah be pleased with him) that (he said): Let the person stand who has heard anything from the Messenger of Allah (peace and blessings be upon him) concerning the fetus. So Haml bin Malik bin al-Nabighah (may Allah be pleased with him) stood and said: "I had two wives; one of them struck the other with a stick and her child miscarried, so he (peace and blessings be upon him) fixed 'a slave' as blood money for it." Sayyiduna Umar (may Allah be pleased with him) said: "Had this not been (heard), I would have given some other ruling about it today."
