Sulayman bin Yasar (may Allah have mercy on him) said that Sayyiduna Zayd bin Thabit (may Allah be pleased with him) ruled a diyah (blood money) of one hundred dinars for an eye that had been put out.
Imam Malik (may Allah have mercy on him) said: This is a matter of ijtihad (independent judgement); nothing is fixed, and Sayyiduna Zayd (may Allah be pleased with him) exercised ijtihad and set it at one fifth of the diyah of the eye.
The Shaykh said: The saying of Sayyiduna Umar (may Allah be pleased with him) also bears the same possibility as the saying of Sayyiduna Zayd (may Allah be pleased with him). And it is also reported from Masruq (may Allah have mercy on him) that for an eye that has been put out, a paralysed hand and a mute tongue, there is this same ruling.
And Ibrahim al-Nakha'i (may Allah have mercy on him) said: For an eye that is put out, a paralysed hand and a mute tongue, a just ruler is to give a judgement.
