باب: الأبوين إذا افترقا وهما في قرية واحدة، فالأم أحق بولدها ما لم تتزوج، وكانوا صغارا، فإذا بلغ أحدهم سبع أو ثمان سنين وهو يعقل خير بين أبيه وأمه، وكان عند أيهما اختار
Chapter: When parents separate while living in the same town, the mother has more right to her children while they are young as long as she does not remarry; when one of them reaches seven or eight years and has understanding, he is given the choice between his father and mother and stays with whichever he chooses

أَخْبَرَنَا أَبُو الْحُسَيْنِ بْنُ بِشْرَانَ، وَأَبُو الْحُسَيْنِ بْنُ الْفَضْلِ الْقَطَّانُ، بِبَغْدَادَ قَالَا: أنبأ إِسْمَاعِيلُ بْنُ مُحَمَّدٍ الصَّفَّارُ، ثنا سَعْدَانُ، ح وَأَخْبَرَنَا أَبُو الْحُسَيْنِ بْنُ بِشْرَانَ، أنبأ أَبُو جَعْفَرٍ مُحَمَّدُ بْنُ عَمْرٍو الرَّزَّازُ، ثنا سَعْدَانُ بْنُ نَصْرٍ، ثنا وَكِيعُ بْنُ الْجَرَّاحِ، ثنا عَلِيُّ بْنُ الْمُبَارَكِ، عَنْ يَحْيَى بْنِ أَبِي كَثِيرٍ، عَنْ أَبِي مَيْمُونَةَ، عَنْ أَبِي هُرَيْرَةَ، قَالَ: جَاءَتِ امْرَأَةٌ إِلَى النَّبِيِّ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ قَدْ طَلَّقَهَا زَوْجُهَا، فَأَرَادَتْ أَنْ تَأْخُذَ وَلَدَهَا، فَقَالَ رَسُولُ اللهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ: " اسْتَهِمَا " فَقَالَ الرَّجُلُ: مَنْ يَحُولُ بَيْنِي وَبَيْنَ وَلَدِي؟ فَقَالَ رَسُولُ اللهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ لِلِابْنِ: " اخْتَرْ أَيَّهُمَا شِئْتَ " فَاخْتَارَ أُمَّهُ، فَذَهَبَتْ بِهِ.
It is narrated from Abu Hurayrah (may Allah be pleased with him) that a woman came to the Prophet (peace and blessings be upon him); she had been divorced, and her husband wanted to take the child from her. He (peace and blessings be upon him) said: "Cast lots." Her husband said: Who wants to come between me and my child? So he (peace and blessings be upon him) gave the child the choice, and he went with his mother.
