Bayhaqi 14876 — Divorce before marriage
أَخْبَرَنَا أَبُو الْحَسَنِ عَلِيُّ بْنُ أَحْمَدَ بْنِ عَبْدَانَ أنا أَحْمَدُ بْنُ عُبَيْدٍ الصَّفَّارُ، نا إِبْرَاهِيمُ بْنُ عَبْدِ السَّلَامِ، نا أَبُو بَكْرِ بْنُ أَبِي شَيْبَةَ، نا وَكِيعٌ، عَنِ ابْنِ أَبِي ذِئْبٍ، عَنْ عَطَاءٍ، عَنْ مُحَمَّدِ بْنِ الْمُنْكَدِرِ، عَنْ جَابِرِ بْنِ عَبْدِ اللهِ رَضِيَ اللهُ عَنْهُ يَرْفَعُهُ قَالَ: " لَا طَلَاقَ قَبْلَ النِّكَاحِ، وَلَا عِتْقَ قَبْلَ مِلْكٍ ".
Sayyiduna Jabir bin Abdullah (may Allah be pleased with him), attributing it to the Prophet (peace and blessings be upon him), said: "There is no divorce before marriage, and no freeing (of a slave) before ownership."
