باب: نكاح المحدثين وما جاء في قول الله عز وجل: الزاني لا ينكح إلا زانية أو مشركة والزانية لا ينكحها إلا زان أو مشرك وحرم ذلك على المؤمنين
Chapter: The marriage of fornicators, and reports on the saying of Allah the Mighty and Majestic: "The fornicator does not marry except a fornicatress or a polytheist woman, and the fornicatress none marries except a fornicator or a polytheist man, and that has been forbidden to the believers"

أَخْبَرَنَا أَبُو نَصْرِ بْنُ قَتَادَةَ، أنبأ أَبُو مَنْصُورٍ النَّضْرَوِيّ، ثنا أَحْمَدُ بْنُ نَجْدَةَ، ثنا سَعِيدُ بْنُ مَنْصُورٍ، ثنا سُفْيَانُ، عَنْ عُبَيْدِ اللهِ بْنِ أَبِي يَزِيدَ، أَنَّهُ سَأَلَ ابْنَ عَبَّاسٍ رَضِيَ اللهُ عَنْهُمَا عَنْ قَوْلِ اللهِ تَعَالَى: {الزَّانِي لَا يَنْكِحُ إِلَّا زَانِيَةً أَوْ مُشْرِكَةً} [النور: ٣] قَالَ: " ذَلِكَ حُكْمٌ بَيْنَهُمَا فَذَكَرَهُ "، قَالَ الشَّافِعِيُّ رَحِمَهُ اللهُ: وَرُوِيَ عَنْ عِكْرِمَةَ أَنَّهُ قَالَ: " الزَّانِي لَا يَزْنِي إِلَّا بِزَانِيَةٍ أَوْ مُشْرِكَةٍ، وَالزَّانِيَةُ لَا يَزْنِي بِهَا إِلَّا زَانٍ أَوْ مُشْرِكٌ، يَذْهَبُ إِلَى أَنَّ قَوْلَهُ يَنْكِحُ يُصِيبُ ".
Ubaydullah bin Abi Yazid asked Sayyiduna Abdullah bin Abbas (may Allah be pleased with them both) about "The fornicator does not marry except a fornicatress or a polytheist woman" [Surah al-Nur: 3]. He said: "This is a ruling between the two of them."
Imam al-Shafi'i (may Allah have mercy on him) says: It is narrated from Ikrimah (may Allah have mercy on him) that the fornicator commits zina only with a fornicatress or a polytheist woman, and none commits zina with the fornicatress except a fornicator or a polytheist man; he takes the word "marries" (yankihu) to mean "has intercourse".
