أَخْبَرَنَا أَبُو عَبْدِ اللهِ الْحَافِظُ، أنبأ أَبُو أَحْمَدَ بَكْرُ بْنُ مُحَمَّدِ بْنِ حَمْدَانَ الصَّيْرَفِيُّ بِمَرْوَ، ثنا أَبُو إِسْحَاقَ إِبْرَاهِيمُ بْنُ هِلَالٍ الْبُوزَنَجِرْدِيُّ، ثنا عَلِيُّ بْنُ الْحَسَنِ بْنِ شَقِيقٍ، ثنا عَبْدُ اللهِ بْنُ الْمُبَارَكِ، عَنْ أَبِي حَنِيفَةَ، عَنْ عَبْدِ الْعَزِيزِ بْنِ رُفَيْعٍ، عَنْ مُجَاهِدٍ، عَنِ ابْنِ عَبَّاسٍ رَضِيَ اللهُ عَنْهُمَا أَنَّ " امْرَأَةً تُوُفِّيَ زَوْجُهَا وَلَهَا مِنْهُ وَلَدٌ، فَخَطَبَهَا عَمُّ وَلَدِهَا إِلَى وَالِدِهَا، فَقَالَ لَهُ: زَوِّجْنِيهَا، فَأَبَى، فَزَوَّجَهَا غَيْرَهُ بِغَيْرِ رَضًا مِنْهَا، فَأَتَتِ النَّبِيَّ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ، فَذَكَرَتْ ذَلِكَ لَهُ، فَأَرْسَلَ إِلَيْهِ النَّبِيُّ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ فَقَالَ: " أَزَوَّجْتَهَا غَيْرَ عَمِّ وَلَدِهَا؟ " قَالَ: نَعَمْ زَوَّجْتُهَا مَنْ هُوَ خَيْرٌ لَهَا مِنْ عَمِّ وَلَدِهَا، فَفَرَّقَ بَيْنَهُمَا وَزَوَّجَهَا عَمَّ وَلَدِهَا كَذَا قَالَ ".
It is narrated from Sayyiduna Ibn Abbas (may Allah be pleased with them both) that a woman's husband died, and she had a son. The boy's paternal uncle sent a marriage proposal for the woman to her father, saying: Marry her to me. But he refused, and he married the woman off without her consent. The woman came to the Prophet (peace and blessings be upon him) and mentioned the whole matter. The Prophet (peace and blessings be upon him) sent a man to him, then said: "Did you marry her to someone other than her son's paternal uncle?" He said: Yes, I married her to a man better than her son's paternal uncle. So the Messenger of Allah (peace and blessings be upon him) separated the two of them and married her to her son's paternal uncle.
